An Act to amend the Motor Traffic Act, 1909, to enable certain offences

under the Clean Air Act, 1961, to be dealt with under section 18B of

the Motor Traffic Act, 1909. [Assented to, 10th June, 1981.]

Motor Traffic (Clean Air) Amendment.

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short tide.

1.      This Act may be cited as the "Motor Traffic (Clean Air) Amendment

Act, 1981".

Commencement.

2.      (1) This section and section 1 shall commence on the date of assent

to this Act.

(2) Except as provided in subsection (1), this Act shall commence on the day appointed and notified under section 2 (2) of the Clean Air (Amendment) Act, 1981.

Amendment of Act No. 5, 1909.

3.      The Motor Traffic Act, 1909, is amended in the manner set forth in

Schedule 1.

AMENDMENTS TO THE MOTOR TRAFFIC ACT, 1909.

(1) Section 18B (1) (c )—

Omit "thereunder; or", insert instead "thereunder;".

(2) Section 18B (1) (d) —

Omit "thereunder,", insert instead "made thereunder; or".

(3) Section 18B (1) (e) —

After section 18B (1) (d), insert:—

(e) has committed any prescribed offence under Part IVA of the Clean Air Act, 1961, or any regulation made under that Act, being an offence relating to the operation of a motor vehicle,

(4) Section 18B (6) (a) —

Omit "offences" where fourthly occurring, insert instead "of the offences, or a specified class of the offences,".

(5) Section 18B (6) (a )—

After "Act" where firstly and secondly occurring, insert "or Part of an Act".

(6) Section 18B (6) (a )—

Omit "or (d)", insert instead ", (d) or (e)".

(7) Section 18B (6) (a )—

After "Act" where thirdly occurring, insert ", Part".
