MOTOR TRAFFIC AND TRANSPORT

(FURTHER AMENDMENT) ACT.

Act No. 57, 1974.

An Act to increase certain fees payable to the Department of Motor Transport; to enable certain fees at present prescribed by the Motor Traffic Act, 1909, and the Transport Act, 1930, to be prescribed in future by regu­ lations under those Acts; for these and other purposes to amend those Acts and the Air Transport Act, 1964; and for purposes connected therewith. [Assented to, 10th October, 1974.1

Parliament assembled, and by the authority of the same, as follows:—

1.     This Act may be cited as the "Motor Traffic and Trans­

port (Further Amendment) Act, 1974".

2.      (1) This section and section 1 shall commence on the

date of assent to this Act.

(2) Except as provided in subsection (1) , this Act shall commence on such day as may be appointed by the Governor in respect thereof and as may be notified by proclamation published in the Gazette.

3. The Motor Traffic Act, 1909, is amended—

(a)

(i)

by omitting from section 3 (1) (jl) the words "and for the payment in respect of any such permit of such fees, not exceeding in any case four dollars, as may be prescribed;" ;

(ii)

by omitting from section 3 (1) (m) the words ", not in any case exceeding four dollars,";

(hi) by omitting section 3 (1) (s) and by inserting

instead the following paragraph : —

(s)

prescribe the fee payable in respect of any application specified in the Schedule, prescribe any other fee and regulate the payment, subject to such exemptions as may be specified, of any prescribed fee or fees and the appli­ cation of any prescribed fee or fees ;

by omitting the Schedule and by inserting instead the following Schedule :—

SCHEDULE.

1.  In this Schedule—

"license" includes renewal of license;
"registration" includes renewal of registration.

2. The fee payable upon an application for registration of a motor

vehicle for a period that exceeds three months is—

(a) in the case of a motor cycle—$5;

(b)

in the case of a motor vehicle that is constructed principally to carry persons and is to be used for the conveyance, for reward, of passengers on a public street—$15; or

(c)

in the case of a motor vehicle other than a motor vehicle referred to in paragraph (a) or (b)—$10.

3. The fee payable upon an application for registration of a motor

vehicle for a period that does not exceed three months is—

(a) in the case of a motor cycle—$1.50;

(b) in the case of a motor vehicle referred to in clause 2 (b)— $4.50; or
(c) in the case of a motor vehicle referred to in clause 2 (c)— $3.

4.  The fee payable upon an application for a license is—

(a)

in the case of an application for a license for a motor vehicle driver (not being an application referred to in paragraph (b))—a fee calculated at the rate of $10 yearly; or

(b)

in the case of an application for a license for a motor cycle rider—a fee calculated at the rate of $8 yearly.

5. The fee payable upon an application for a learner's permit is $5.

6. The fee payable upon an application by a person to have a

certificate of registration of a motor vehicle transferred to him is—

(a) where the motor vehicle is not a motor cycle—$6; or
(b) where the motor vehicle is a motor cycle—$3.

7. The fee payable upon an application for a trader's plate (being

a special number-plate referred to in section 3 (1) (q2)) is—

(a) in the case of a trader's plate for use on a motor vehicle other than a motor cycle—a fee calculated at the rate of $75 yearly; or
(b) in the case of a trader's plate for use on a motor cycle—a fee calculated at the rate of $18 yearly.

8. Notwithstanding the provisions of this Schedule, where a fee is prescribed by the regulations in respect of an. application specified in this Schedule, the fee payable in respect of that application is the fee prescribed by the regulations.

4. The Transport Act, 1930, is amended—

(a)

by omitting from section 152 (4) the words "of this Act" and by inserting instead the words "or, where some other amount is prescribed by the regu­ lations in respect of an application, that other amount" ;

(b)

by omitting Schedule Two and by inserting instead the following Schedule :—

APPLICATION FEES.

1. Item 2 applies subject to section 152 (4) .

1. Provisional service license . . . . $4

5. The Air Transport Act, 1964, is amended by omitting

from section 5 (1) (c) the words "two dollars" and by

inserting instead the matter "$3".
