MOTOR TRAFFIC AND TRANSPORT
(AMENDMENT) ACT.

Act No. 31 , 1974.
An Act to provide for the conversion to metric terms of speed limits for motor vehicles; for this purpose to amend the Motor Traffic Act, 1909, and the Transport Act, 1930; and for purposes connected therewith. [Assented to, 19th April, 1974.]

| Parliament assembled, and by the authority of the same, as follows:— |
1. This Act may be cited as the "Motor Traffic and
Transport (Amendment) Act, 1974".
2. This Act shall commence on 1st July, 1974.
The Motor Traffic Act, 1909, is amended—
(a) (i) by omitting from section 4A (1) (a) (i) the words "thirty-five miles" and by inserting instead the words "sixty kilometres";
(ii) by omitting from section 4A (1) (b) the words "fifty miles" and by inserting instead the words "eighty kilometres";
(b)
by omitting from section 10 (3B) the words "thirty miles" and by inserting instead the words "sixty kilometres".
4. The Transport Act, 1930, is amended by omitting from
section 264 (1) (t) the words "thirty miles" and by inserting
instead the words "sixty kilometres".
(1) For the purposes of this section the kilometre speed per hour equivalent of a speed expressed in miles per hour is the speed in kilometres per hour referred to in the Second Column of the Schedule opposite to the reference in the First Column of the Schedule to that speed expressed in miles per hour.

(2) A speed limit fixed by a direction given under section 4A (3) (c) of the Motor Traffic Act, 1909, at a speed expressed in miles per hour that is applicable to a length of public street immediately before the commencement of this Act shall be treated, on and after that commencement, as a speed limit fixed at the kilometre speed per hour equivalent of that speed expressed in miles per hour.
(3) Where a sign, displayed pursuant to section
4A (4) of the Motor Traffic Act, 1909, to indicate a speed
limit applicable to any length of public street, contains the words "Speed Limit", then for the period ending on the day that is three months after the commencement of this Act—
(a)
any figures displayed on the sign shall be treated as expressing a speed in miles per hour; and
(b)
the speed limit indicated by the sign shall be deemed to be the kilometre speed per hour equivalent of that speed in miles per hour.
(4) Nothing in this Act shall—
(a) affect proceedings for an offence committed before
the commencement of this Act; (b) operate so as to prevent the Minister revoking or varying under section 4A (3) of the Motor Traffic Act, 1909, a direction given by him; or (c) be construed as requiring any alteration of any sign displayed pursuant to section 4A (4) of that Act. SCHEDULE
