Motor Traffic (Amendment) Act (No. 6) 1990

An Act to amend the Motor Traffic Act 1936

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Motor Traffic (Amendment) Act (No. 6) 1990.

Principal Act

2.  In this Act, “Principal Act” means the Motor Traffic Act 1936.1

Driving licence to be signed

3.  Section 15 of the Principal Act is amended by omitting “Penalty: $40.”.

Sale or disposal of vehicle

4.  Section 22 of the Principal Act is amended by omitting from subsection (2) “Penalty: $200.”.

Careless or inconsiderate driving

5.  Section 130 of the Principal Act is amended by omitting “Penalty: $100.”.

Wearing of seatbelt by driver of prescribed vehicle

6.  Section 164B of the Principal Act is amended by omitting “punishable, on conviction, by a fine not exceeding $80”.

Wearing of seatbelts by passengers in prescribed vehicles

7.  Section 164C of the Principal Act is amended by omitting from subsection (2) “punishable, on conviction, by a fine not exceeding $80”.

Children and young persons in prescribed vehicles

8.  Section 164D of the Principal Act is amended—

(a)by omitting from subsection (1) “punishable, on conviction, by a fine not exceeding $80”;

(b)by omitting from subsection (2) “punishable, on conviction, by a fine not exceeding $80”; and

(c)by omitting from subsection (3) “punishable, on conviction, by a fine not exceeding $80”.

Traffic infringement notices

9.  Section 180A of the Principal Act is amended—

(a)by omitting from subparagraph (1) (b) (i) “$40” and substituting “$70”;

(b)by omitting from subparagraph (1) (b) (ii) “$60” and substituting “$100”;

(c)by omitting from subparagraph (1) (b) (iii) “$80” and substituting “$130”;

(d)by omitting from subparagraph (1) (c) (i) “$50” and substituting “$80”; and

(e)by omitting from subparagraph (1) (c) (ii) “$80” and substituting “$130”.

General offences

10.  Section 192 of the Principal Act is amended by inserting in subsection (2) “, whether by virtue of subsection (1) or otherwise,” after “Act”.

Schedule 6

11.  Schedule 6 to the Principal Act is amended—

(a)by omitting from the third column of item 1 “20” and substituting “30”;

(b)by omitting from the third column of item 2 “30” and substituting “50”;

(c)by omitting from the third column of item 3 “40” and substituting “70”;

(d)by omitting from the third column of item 4 “50” and substituting “80”;

(e)by omitting from the third column of item 5 “60” and substituting “100”;

(f)by omitting from the third column of item 6 “80” and substituting “130”;

(g)by omitting from the third column of item 7 “10” and substituting “20”; and

(h)by omitting from the third column of item 8 “20” and substituting “30”.
