AN ORDINANCE

To amend the Motor Traffic Ordinance 1936

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administra­ tion) Act 1910.

MOTOR TRAFFIC (AMENDMENT) ORDINANCE (No. 5)

1. This Ordinance may be cited as the Motor Traffic (Amend­

ment) Ordinance (No. 5) 1977.*

2 . In this Ordinance, " Principal Ordinance " means the Motor

Traffic Ordinance 1936.f

3 . (1 ) Section 84 of the Principal Ordinance is amended by omit­ ting sub-section (4) and substituting the following sub-section:

" (4 ) The nominal defendant shall, as soon as practicable after the end of each calendar year, prepare and furnish to the Minister a report concerning his operations during that year.".

(2) The amendment made by this section applies in relation to—

(a)

the calendar year that commenced on 1 January 1977; and

(b) each subsequent calendar year.

4.   Section 149 of the Principal Ordinance is amended—

(a)

by omitting from sub-section (1) the definition of "busi­ ness hour s " and substituting the following definition:

" ' business hours ' means—

(a)

the period commencing at 9 o'clock in the morning and ending at half past 5 o'clock in the afternoon on Monday, Tuesday, Wednesday and Thursday;

(b)

the period commencing at 9 o'clock in the morning and ending at 9 o'clock in the evening on Friday; and

(c)

the period commencing at 9 o'clock in the morning and ending at 12 noon on Saturday,

other than a period on a day that is a public holiday;"; and

(b)

by omitting sub-section (3) and substituting the following sub-section:

" ( 3 ) Where the expression 'business hours ' is

inscribed on a no parking sign, a no stopping sign, a parking sign or a loading zone sign, that expression has the effect of indicating that the prohibition or qualification on parking or stopping by the sign operates during—

(a)

the period commencing at 9 o'clock in the morning and ending at half past 5 o'clock in the afternoon on Monday, Tuesday, Wednesday and Thursday;

(b)

the period commencing at 9 o'clock in the morning and ending at 9 o'clock in the evening on Friday; and

(c)

the period commencing at 9 o'clock in the morning and ending at 12 noon on Saturday,

other than a period on a day that is a public holiday.".
