AN ORDINANCE

To amend the Motor Traffic Ordinance 1936.

I, T H E GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administra­ tion) Act 1910.

MOTOR TRAFFIC (AMENDMENT) ORDINANCE (No. 4) 1977

1. This Ordinance may be cited as the Motor Traffic (Amend­

ment) Ordinance (No. 4) 1977.*

2. In this Ordinance, "Principal Ordinance" means the Motor Traffic Ordinance 1936.f

3. Section 4 of the Principal Ordinance is amended by omitting the definition of " t r a i l e r " in sub-section (1) and substituting the following definition:—

" ' trailer ' means—

to Ordinance N o . 16,1977. For amendments made during 1977 see Ordinances Nos. 16,23 and 30. 1977.
(a) a vehicle without motive power designed for attach­ ment to a motor vehicle, but does not include a side-car; and
(b) a piece of machinery or equipment that is equipped with wheels and designed to be towed behind a vehicle, but is not designed as a means of conveyance;".

4. Section 10 of the Principal Ordinance is amended by adding at the end thereof the following sub-section:—

" (8) Notwithstanding the provisions of section 14, where—

(a)

the applicant for a licence or renewal of a licence to drive a motor vehicle is, at the time of the application, the

holder of a licence to drive a motor vehicle of a class other than the class in respect of which the applicant is applying for the licence or renewal; and

(b)

fees in accordance with Schedule 1 were paid in respect of the grant or renewal of the second-mentioned licence,

no fee is payable in respect of the grant or renewal of the the first-

mentioned licence.".

5. Section 14 of the Principal Ordinance is amended by omitting

sub-section ( 2 ) .

6. Schedule 1 to the Principal Ordinance is repealed and the follow­

ing Schedule substituted:—

1. (1) Registration or renewal of registration of a motor vehicle, being a motor car,

motor lorry, motor tractor, public motor vehicle or motor omnibus:—

(a) motor vehicle other than a motor tractor—

(i) where the mass of the vehicle does not exceed 2 tonnes . . 56

(ii)  where the mass of the vehicle exceeds 2 tonnes but does not exceed 4 tonnes —a fee of $56 plus $12 for each 250 kilograms or part of 250 kilograms by which the mass of the vehicle exceeds 2 tonnes;

(iii)  where the mass of the vehicle exceeds 4 tonnes—a fee of $152 plus $18 for each 250 kilograms or part of 250 kilograms by which the mass of the vehicle exceeds 4 tonnes;

(b) motor tractor . . . . . . 25

(2) In the case of—

(a) a motor tractor owned by a farmer and used solely for the carting of his own pro­ duce; or
(b) a motor lorry owned by a farmer and used solely for the carting of his own pro­ duce,

not being a motor tractor or motor lorry that is let out on hire, the fee payable by virtue of sub-clause (1) for the registration, or the renewal of the registration, of the motor tractor or motor lorry is one-half of the amount that would, but for this sub-clause, be payable by virtue of sub-clause (1).

(3) In addition to the amount payable by virtue of sub-clause (1), a fee of $25 is payable

for the registration of a motor vehicle referred to in that sub-clause.
