Motor Traffic (Amendment) Ordinance 1981

An Ordinance to amend the Motor Traffic Ordinance 1936

Short title

1. This Ordinance may be cited as the Motor Traffic (Amendment) Ordinance

1981. 1

Commencement

2. This Ordinance shall come into operation on 1 March 1981.

Principal Ordinance

3 . In this Ordinance, "Principal Ordinance" means the Motor Traffic

Ordinance 1936. 2
(d) by omitting from paragraph (b) "junction or".

Motorist to give way to vehicles on his right at intersections

4. Section 122 of the Principal Ordinance is amended—

(a)

by omitting from paragraph (a) "approaching the junction or inter­ section" (wherever occurring) and substituting "approaching the inter­ section";

(b)

by omitting from paragraph (a) "a junction or intersection at" (wherever occurring) and substituting "an intersection a t" ;

(c)

by omitting from sub-paragraph (a) (iii) "the junction or intersection" and substituting "the intersection"; and

5. After section 122 of the Principal Ordinance the following section is

inserted:

Give way rule to be observed at uncontrolled junctions

"122A. Where—

(a)

a motor vehicle upon a public street is approaching, or has entered, the junction of that public street and another public street;

(b)

the public street upon which the motor vehicle is approaching the junc­ tion, or from which the motor vehicle entered the junction, as the case may be, is the street that does not pass through the junction;

(c)

another motor vehicle, being driven along the public street that passes through the junction, is approaching, or has entered, the junction;

(d) the junction is not—

(i)  a junction at, near or within which there is erected a traffic sign bearing the words "GIVE WAY" or the word "STOP" and facing in the direction from which either of the motor vehicles is approaching, or entered, the junction;

(ii)  a junction at, near or above which there are traffic lights dis­ playing a light of a description specified in the first column of the table in sub-section 112B (1); or

(iii)  a junction at which a member of the Police Force in uniform is giving directions regulating or controlling the movement of traffic entering or passing through the junction; and

(e)

the circumstances are such that there is a reasonable possibility that the vehicles might collide or that a dangerous situation might otherwise be created,

the driver of the motor vehicle referred to in paragraph (a) shall allow the other

motor vehicle to pass in front of him.".

Application of sections 121,122 and 122A

6. Section 123 of the Principal Ordinance is amended by omitting "sections

121 and 122 of this Ordinance" and substituting "sections 121, 122 and 122A". NOTES
