AN ORDINANCE

To amend the Motor Traffic Ordinance 1936

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Adminis­ tration) Act 1910.

MOTOR TRAFFIC (AMENDMENT) ORDINANCE 1978

1. This Ordinance may be cited as the Motor Traffic (Amend­

ment) Ordinance 1978.*

2 . In this Ordinance, "Principal Ordinance" means the Motor Traffic Ordinance 1936.f

3 . Section 4 of the Principal Ordinance is amended by omitting the

definition of "off-street parking a rea" in sub-section (1) and sub­
stituting the following definition:

52 and 54, 1976; and Nos. 16, 23, 30, 37, 51 and 59, 1977.

" 'off-street parking area ' means an area of land available for
use by the public, whether with or without the payment of

money, for the parking of motor vehicles, and includes—

(a)	the entrances to, the exits from and the passage­ ways in such an area; and
(b)	the area of land that is situated between the entrances to and the exits from such an area and a public street and that is used for access to the area.".

4. Section 38 of the Principal Ordinance is repealed.

5. After section 108G of the Principal Ordinance the following

section is inserted in Part V I I :

" 109A. For the purposes of this Part, an off-street parking area

shall be deemed to be part of a public street.".

6 . After section 112 of the Principal Ordinance the following

section is inserted in Part V I I A :

" 112AA. For the purposes of this Part, an off-street parking area

shall be deemed to be part of a public street.".
