MOTOR TRAFFIC AMENDMENT

ACT.

Act No. 1 1 , 1915 .

An Act to amend the Motor Traffic Act, 1 9 0 9 ;

and for other purposes. [Assented to, 22nd
February, 1915.]

"Wales in Parliament assembled, and by the authority of

the same, as follows :—

1. This Act may be cited as the " Motor Traffic

Amendment Act, 1915 ."

2. Section three of the Motor Traffic Act, 1909, is

amended—

(a) by inserting in the proviso following clause (n) after the words "public vehicles" the words " under the Metropolitan Traffic Act, 1900 " ;

(< l2 )
(b) by omitting from the same proviso the words " or to motor vehicles owned by a person resi­ dent in another State and temporarily in this State or to the drivers thereof" ;
(c) by inserting after paragraph (q) the following paragraphs : —

(q 1 ) provide for the temporary registration of motor vehicles owned by persons resident outside this State and temporarily in this State, and the drivers thereof ;

(q 2) provide for the issue of spceial number- plates to manufacturers of, or dealers in, motor vehicles for use upon any motor

vehicle in their possession on trial before or after completion, and prescribe the con­

ditions under which such plates may be used.

3 . Section four is amended by the omission of

subsection three.

4 . Section live is amended by omitting subsections

one and two and inserting :—

(1) Any driver of a motor vehicle who, when

required by a member of the police; force in the
execution of his duty under this Act or the regula­
tions to produce his license and state his name and

place of abode refuses to do so, or, when so required,

states a false name or place of abode, shall be guilty

of an offence under this Act.

(2) Any person who drives a motor vehicle whilst

he is under the influence of intoxicating liquor
shall he guilty of an offence under this Act.

5 . Section six is amended by the omission of para­ graph (c) and the insertion of the following paragraph in lieu thereof :—

(c)

drives or causes or permits to be driven upon any public street a motor vehicle—-

(i) not having 1 he prescribed number plate

properly affixed thereto ; or

(ii) having the number plate obscured so

that the numbers upon such plate are

not clearly visible ; or
number plate obliterated by paint or any
other material; or

(iii) having the original numbers upon the

(iv) having the number plate so damaged

that the original numbers are not com­

plete and distinctly visible.

6. The following sections are inserted next after

section eight:—

8A. Any person who drives or uses any motor

vehicle without first obtaining the consent of flic

owner thereof shall be guilty of an offence under

this A c t :  Provided

Provided that the provisions of this section shall

not apply to a member of the police force in the

execution of his duty under this Act or the
Regulations.

8B. Any person who procures the use or hire of any motor car by fraud or misrepresentation, and any person who aids or abets any such person shall

be guilty of an offence under this Act.

7. Subsection one of section ten is amended as

follows :—

(a) After " may " where first occurring insert the words " impose a penalty not exceeding twenty pounds for every such offence, and any court

before whom a person is convicted of an offence under this Act or the regulations may "

(b) Omit paragraph (a) .

8. Section eleven is amended by omitting the words

" made by any municipal or shire council, or other local

authority".

9 . Section eighteen is amended by omitting para­

graphs (c) and (d).

1 0 .     The Schedule to the Act is amended—

(a) in the first paragraph by inserting after " motor
vehicles " the words " including tricars " and
by omitting " or tricycles " ;
(b) in the second paragraph by omitting " or tri­

cycles " ; and

(c) in the fourth paragraph by omitting the words

" in substitution for license lost or destroyed."
