MOTOR TRAFFIC.

No. 17 of 1962.

An Ordinance to amend the Motor Traffic Ordinance 1936-1960, as amended by the Motor Traffic Ordinance 1962.

1.—(1.) This Ordinance may be cited as the Motor Traffic short title

Ordinance (No. 2) 1962.* andd*,,™.

(2.) The Motor Traffic Ordinance 1936-1960,f as amended by the Motor Traffic Ordinance 1962,$ is in this Ordinance referred to as the Principal Ordinance.

(3.) Section one of the Motor Traffic Ordinance 1962 is amended by omitting sub-section (3.).

(4.) The Principal Ordinance, as amended by this Ordi-
nance, may be cited as the Motor Traffic Ordinance 1936-1962.

2. This Ordinance shall come into operation on a date to be fixed by the Minister by notice published in the Gazette. §

3. Section four of the Principal Ordinance is amended by interpretation.

inserting in sub-section (1.), after the definition of " officer ",
the following definition:—

" ' one way traffic carriageway' means a carriageway or separate portion of a carriageway in respect of which traffic signs bearing an arrow and the words ' ONE WAY' are erected or displayed;".

4. Section fifty-six A of the Principal Ordinance is repealed and the following section inserted in its stead:—

5. Section fifty-six H of the Principal Ordinance is Right hand

amended—

(a) by omitting paragraph (b) of sub-section (1.) and

inserting in its stead the following paragraph:—

"(b) if the motor vehicle is being driven on
a one way traffic carriageway—as

near as practicable to the right hand side of that one way traffic carriage- way; "; and

(b) by omitting sub-section (3.) and inserting in its stead the following sub-sections:—

" (3.) Subject to the next two succeeding sub- sections and to section fifty-six JA of this Ordi- nance, the driver of a motor vehicle upon a public street shall not turn or continue to turn his motor vehicle to his right if there is, in the public street, a vehicle approaching from the direction oppo- site to that in which he is or was facing imme- diately before commencing to turn and with which he might collide if he turned or continued to turn his motor vehicle.

" (3A.) The last preceding sub-section does not apply in relation to the turning of a motor vehicle by reason only of following the course of the carriageway of the public street.

" ( 3 B . ) For the purposes of sub-section (3.) of this section, where the driver of a motor vehicle upon a public street turns, or commences to turn, his motor vehicle to his right, he shall be taken to continue to turn his motor vehicle to his right until his motor vehicle has either left that public street or is proceeding along the public street in the direction opposite to that in which it was proceeding before he commenced to turn it.".

and junctions, (a) by adding at the end of paragraph (a) the words ", not being a junction or intersection at, near or within which is erected a traffic sign bearing the words ' GIVE WAY ' and facing in the direc- tion of vehicles approaching the junction or intersection from that other public street;"; and
(b) by inserting in paragraph (b), after the word " right", the words " along that other public street".

7. After section fifty-six J of the Principal Ordinance the

following section is inserted:—

(a ) where there are two adjacent one way traffic
carriageways provided respectively for vehicles
travelling in opposite directions—those two

carriageways and any areas of carriageway con- necting them shall be taken to be one public street; and

(b) a motor vehicle travelling on a public street (whether or not it is a public street referred to in the last preceding paragraph) shall be taken to remain in that same public street while the motor vehicle is within—

(i) an area of carriageway that is common to that public street and another public street; or

(ii) an area of carriageway bordered by traffic islands that are in or related to an intersection or junction of that public street with another public street.".
