AN OEDINANCE

I To amend the Motor Traffic Ordinance 1936-1951. as

amended by the Motor Traffic Ordinance 1955.

Executive Council, in pursuance of the powers conferred by the BE it ordained by the Governor-General in and over the Commonwealth of Australia, with the advice of the Federal
Seat of Government (Administration) Act 1910-1947, as follows:—

1.—(1.) This Ordinance may be cited as the Motor Traffic short title

Ordinance (No. 2) 1955.* and citato.
(2.) The Motor Traffic Ordinance 1936-1951,f as amended by the Motor Traffic Ordinance 1955,\ is in this Ordinance referred to as the Principal Ordinance.
(3.) Section one of the Motor Traffic Ordinance 1955 is amended by omitting sub-section (3.).
(4.) The Principal Ordinance, as amended by this Ordinance, may be cited as the Motor Traffic Ordinance 1936-1955.

2. Section sixty A of the Principal Ordinance is amended by unauthorized insert ing after the word " rates " the words " or any motor tractor !o?rielTcOTby in respect of which he has paid the registration fee specified in farmers

sub-paragraph (i) of paragraph (d) of sub-clause (I.) of clause 1

of the Second Schedule ".

3. The Second Schedule to the Principal Ordinance i.s amended second

by omitting clauses 1, 2 and 3 and inserting in their stead the

following clauses:—

" 1 . — (1.) Registration or renewal of registration of any motor

vehicle, being a motor car, motor lorry, motor tractor or public

motor vehicle:—

(a) motor car or public motor vehicle (other than a motor

omnibus)—at the rate of 3s. (id. per half cwt. of its

weight;

I (o) motor lorry—

(i) of weight not exceeding 40 cwt.—at the rate of

3s. 6d. per half cwt. of its weight;

(ii) of weight exceeding 40 ewt. but not exceeding 80 cwt.—at the rate of 4s. 3d. per half cwt. of its weight;

(iii) of weight exceeding 80 cwt. but not exceeding 120 cwt.—at the rate of 5s. per half ewt. of its weight;

(iv) of weight exceeding 120 cwt.—at the rate of

5s. 9d. per half cwt. of its weight;

(c) motor omnibus—at the rate of 5s. per half ewt. of its

weight;

(d) motor tractor— £ s. d.

(i) where the tractor is owned by a
farmer and used solely for the

carting of his own produce and not

let out on hire . . . . 1 0 0
(ii) in any other case . . . . 5 0 0

" (2.) In the case of a motor lorry owned by a farmer and used solely for the carting of his own produce and not let out on hire, the rate shall be one-half of the rate which would, but for this sub-clause, be applicable to that motor lorry.

" 2. Registration or renewal of registration of a motor cycle—

" 3. Registration or renewal of registration of any

" 3A.—(1.) Notwithstanding anything contained in clause 1
or clause 2 of this Schedule, the fee payable for registration or

renewal of registration of a motor car, motor lorry, public motor

which would, but for this clause, be payable in respect of that vehicle or motor cycle, being a diesel vehicle, shall be twice the fee
vehicle under clause 1 or clause 2 of this Schedule.

" (2.) For the purposes of this clause, 'diesel vehicle' means a vehicle propelled by an internal combustion engine ordinarily using a liquid fuel with a true flashing point of not less than 73 degrees Fahrenheit as determined in the manner prescribed by the Inflammable Liquids Ordinance 1940-1941.".

Application of 4. The amendments made by the last preceding section apply
amendments
of Second in relation to—
Schedule.

(a) the registration of a motor vehicle effected on or after the twelfth day of September, One thousand nine hundred and fifty-five; and

;}

(b) the renewal of the registration of a motor vehicle where the registration or the last preceding renewal of the registration, as the case may be, expires or has expired on or after that date.
