§ AUSTRALIAN CAPITAL TERRITORY.

No. 13 of 1947.

I AN ORDINANCE

To amend the Motor Traffic Ordinance 1936*1945,

as amended by the Motor Traffic Ordinance 1947.*

BE it ordained by the Governor-General in and over the Com-Executive Council, in pursuance of the powers conferred by the monwealth of Australia, with the advice of the Federal Seat of Government Acceptance Act 1909-1938 and the Seat of
Government {Administration) Act 1910-1947, as follows:—

1.— (1.) This Ordinance may be cited as the Motor Traffic short title

Ordinance (No. 2) 1947.* and citation.
(2.) Section one of the Motor Traffic Ordinance 1947 is

amended by omitting sub-section (3 . ) .

(3.) The Motor Traffic Ordinance 1936-1945, as amended by the Motor Traffic Ordinance 1947, is in this Ordinance referred to as the Pr incipal Ordinance.

(4.) The Pr incipal Ordinance, as amended by this Ordinance,

may be cited as the Motor Traffic Ordinance 1936-1947.
2. Section nine of the Principal Ordinance is amended— Granting of
licences.

(a) by omitting from sub-section (1.) the words "or motor
cycle" and inserting in their stead the words " a

licensed goods motor vehicle or a motor cycle " ; and

(b) by inserting after sub-section (2.) the following sub-

section :—

" (2A.) The Eegistrar may grant a licence to drive a licensed goods motor vehicle to any person who satisfies him that he is not less than seventeen years of age and is capable of driving a vehicle of that class with safety to the public and produces to the Registrar a certificate of good character signed by not less than two persons of good repute, and the Registrar may renew that licence from time to time.".

3 . Section fifteen of the Pr inc ipa l Ordinance is amended by Fixing of

4. Section seventy-eight of the Principal Ordinance I

amended—

(a) by omitting sub-paragraph (ii) of paragraph (d) and inserting in its stead the following sub-para- graph :—

" (ii) the registered number of the trailer is in a position satisfactory to the Registrar; and " ; and I

(6) by omitting from sub-paragraph (iii) of that para-

graph the words " of the motor vehicle ".

5. After section one hundred of the Principal Ordinance the following section is inserted:—

The Registrar may, in his discretion, grant a permit in respect of a licensed goods motor vehicle authorizing the carriage on the motor vehicle of any persons in such circum- stances (other than in the circumstances referred to in the last preceding section) and upon such conditions as to safety or other- wise as are specified in the permit by the Registrar.

" (2.) A permit may, at the discretion of the Registrar, provide that no monetary or other material consideration shall be charged or received by any person in respect of the carriage of any person on a licensed goods motor vehicle.

" (3.) A permit shall be in force for such period not exceeding one month as is specified therein:

Provided that, in special circumstances, the Registrar may specify a period in excess of one month.

" (4.) A person shall not carry a number of persons greater
than the number specified in the permit or in or on an area, district,
route or road other than that so specified or contrary to the
circumstances and conditions so specified. *

" (5.) The person driving a licensed goods motor vehicle in respect of which a permit is issued shall carry the permit on the

motor vehicle and shall, on demand by an inspector or an officer
authorized in that behalf by the Registrar or by any member of the
Police Force, produce the permit for inspection by the inspector, I
officer or member.

" (6.) The holder of a permit shall, if so' required by the Registrar, pay, in addition to other moneys payable under this Ordinance, such fee as is specified in the Second Schedule.".

Licence to 6. Section one hundred and one of the Principal Ordinance is

7. The Second Schedule to the Principal Ordinance is Amendment 1 of Second
amended— schedule.

(a) by inserting in sub-clause (b) of clause 4, after the words " private hire car ", the words ", a licensed goods motor vehicle " ; and

(b) by adding at the end thereof the following clause:—

" 9. Permit to carry persons on a licensed

goods motor vehicle . . . . 0 3 6 " .
