SPIRIT VENDORS ACT [ASSENTED TO 12TH DECEMBER, 1934.] AMENDMENT B AOT OF 1934. E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lativeAssemblyof Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. This Act may be cited as "The ~lJ10tor Spirit :::struction. Vendors Act Amendment Act of 1934," and shall be read as one with *" The Motor Spirit Vendors Act of 1933," herein referred to as the Principal Act. Collective The Principal Act and this Act may collectively title. be cited as "The ~ lJ10tor Spirit Vendors Acts, 1933 to 1934." * 24 Geo. V. No. 11, supra, page 14709.
1934. MOTOR SPIRIT VENDORS. Motor Spirit Venclors L1et Amendment Aet. 15093 Amendments of the Principal Act. 2. The following new section lA is inserted after New s. lA. section one of the P:rincipal Act, as follows :- " [lA.] This Act shall be read and construed subjectAct.read to the *Commonwealth of Australia Constitution Act and ~~ ~Jc~r! ~ so as not to exceed the legislative power of the State, monw.ealt.h to the intent that, where any enactment thereof would ConstltutIOn. but for this section have been construed as being in excess of that power, it shall nevertheless be a valid enactment to the extent to which it is not in excess of that power." 3. Section two of the Principal Act is amended as Amendment follows :_ of s. 2. (a) The following proviso is added to the definition of" Motor spirit," namely :- " Provided that the term" Motor spirit" does not include motor spirit being the subject of interstate trade or commerce within the meaning of section ninety-two of the CommonwealthConstitution, but such term includes only such motor spirit as is or hereafter shall be part of the general mass of property in Queensland which is completely under the power and control of the State of Queensland." (b) The definition of " To sell" is repealed. 4. A new section 6A is inserted after section six of New s. 6A. the Principal Act, as follows :- " [6A.] Notwithstanding anything herein contained, ~ ase. ~ here the Treasurer. shall exempt either wholly or in part .any ~~ ~ ~~ ~ ty to holder of a lIcense under this Act from the provisIOns power of section six thereof under the following circumstances, alcohol. that is to say:- (a) He shall exempt wholly any such holder who satisfies him that he is unable to obtain any power alcohol manufactured in Austmlia. (b) He shall exempt in part any such holder who satisfies him that he is able to obtain part only of the power alcohol manufactured in Australia necessary to enable him to comply * 63 and 64 Vie. c. 12, supra, page 4565.

No. 35, 1934. with the provisions of section six of this Act, to the intent that such holder so purchasing such part so obtainable shall be deemed to comply with the provisions of the said section six. The Treasurer shall notify such holder of any such exemption by certificate under his hand; the period of such exemption shall be fixed by the Treasurer and stated in such certificate: Provided that the Treasurer may from time to time renew any such certificate."
