An Ordinance to amend the Motor Omnibus Services Ordinance 1955.
Short title
1. Tnis Ordinance may be cited as the Motor Omnibus Services (Amendment) Ordinance (No. 2) 1981. 1
Principal Ordinance
2. In this Ordinance, "Principal Ordinance" means the Motor Omnibus
Services Ordinance 1955.2
Interpretation
3. Section 2 of the Principal Ordinance is amended—
" 'student nurse' means a full-time student attending a general nursing course conducted by the Capital Territory Health Commission and who is not in receipt of an income exceeding the maximum living allowance specified in sub-regulation 41 (2) of the Student Assistance Regulations made under the Student Assistance Act 1973;";
(a) by inserting after the definition of "child" in sub-section (1) the following definition:
" 'immigrant student' means a full-time student, other than a school student, attending a course of instruction that is an approved course of instruction within the meaning of the Immigration (Education) Act 1973;";
(b)
by inserting after the definition of "stopping place" in sub-section (1) the following definition:
| (c) | by inserting after the definition of "tertiary education institution" in sub-section (1) the following definition: |
" 'tertiary student' means a full-time student attending a course of study or instruction at a tertiary education institution, being a student who is under the age of 25 years or who has been granted Tertiary Education Assistance under the Student Assistance Act 1973;"; and
(d) by adding at the end of sub-section (1) the following definition:
" 'unemployed person' means a person to whom there is being paid
an unemployment benefit under the Social Services Act 1947.".
4. After section 4BA of the Principal Ordinance the following section is
inserted:
Weekly tickets
"4BB . (1) The Minister may make such arrangements as he considers
necessary for the sale of weekly tickets for use on motor omnibus services by—
(a) children;
(b) school students;
(c) tertiary students;
(d) immigrant students;
(e) student nurses; (f) pensioners; and (g) unemployed persons.
"(2) The price payable for weekly tickets is the price specified in the
regulations.
"(3) A person who has purchased a weekly ticket is, on production of the
ticket to the driver or conductor of an omnibus, entitled, at any time during
the period to which the ticket is expressed to be applicable, to travel on that
| omnibus without payment of a fare. |
"(4) A person who, for the purpose of avoiding payment of the fare for a
journey on an omnibus—
| (a) | produces to the driver or conductor of the omnibus a weekly ticket on a day that is not within the period to which the ticket is expressed to be applicable; or |
| (b) | produces to the driver or conductor of the omnibus a weekly ticket, not being a weekly ticket purchased by the person, |
is guilty of an offence and punishable, on conviction, by a fine not exceeding
$50.
"(5) A weekly ticket shall be expressed to be applicable to a period of 7
days, being a period commencing on a Monday.".
Quarterly tickets
5. Section 4CB of the principal Ordinance is amended by omitting para
graphs (1) (b) and (c) and substituting the following paragraphs:
"(b) school students;
(c) tertiary students;
(d) immigrant students;
(e) student nurses;
(f) pensioners; and(g) unemployed persons.".
Student cards
6. Section 4cc of the Principal Ordinance is amended—
(a)
by omitting from sub-section (1) "a person who is a full-time student attending a course of study or instruction at a tertiary education institution, issue to the student or person" and substituting "a tertiary student, issue to the student";
(b) by omitting from paragraph (1) (a) "or person";
(c) by omitting paragraph (1) (b) and substituting the following paragraph:
"(b) the name and address of the school or tertiary educationinstitution attended by the student.";
(d)
by omitting from paragraph (3) (c) "a person who is a full-time student attending a course of study or instruction at a tertiary education institution" and substituting "a tertiary student"; and
(e)
by omitting from paragraph (3) (e) "attended by the person or the tertiary education institution at which the person attends a course of study or instruction" and substituting "or tertiary education institution attended by the person".
