PART I.—PRELIMINARY.
1. These Regulations may be cited as the Motor Omnibus short title.
Regulations.
2. These Regulations shall commence on the fourteenth day.of June, commencoment

Definition*. In these Regulations, unless the,, contrary intention appears—
" conductor" means a conductor of an omnibus, and includesa driver of an omnibus on which no conductor is employed; " conductor's licence " means a conductor's licence granted under
these Regulations;
" footpath" means the path Or .place, between the kerb and property lines adjoining^ a public street, set apart for the •' exclusive use of pedestrians;
" licensee " means a licensee, under a service licence;"medical testing officer " means an officer appointed;under the
Ordinance to be a medical testing officer;
" official traffic s ign" means any notice, sign or other device marked, placed or erected oh or.at the side of a public street by authority of the Minister for the purpose of guiding, directing, regulating or warning motor vehicles or traffic;
"omnibus" means a motor omnibus;
" omnibus service " means a motor omnibus passenger service;
" omnibus stop." means an omnibus stop specified in the SecondSchedule to these Regulations and indicated by an official traffic sign;
"pa rk ing" means the standing or waiting on a public street of a motor vehicle, whether occupied or not, when not actually engaged in .picking up or setting down persons, passengers or goods, or when not required to stop in obedience to official traffic signs or signals by a member of the Police Porce, and " p a r k " or "parked" has a corre- sponding meaning;
"parking a rea" means.a parking area specified in the Second "Schedule to the Motor Traffic Regulations and indicated by an official traffic sign;"•public stand"- means a public stand specified in the Schedule to the Motor Hire Car Regulations and indicated by an official traffic sign;
" registration " means registration under the Ordinance;
" roadway" means that part of a public street open to, or used
by, vehicular traffic, but does not include a footpath;
"service licence" means a licence to conduct an omnibus
service;
" testing officer " means an officer appointed under the Ordinance
to be a testing officer; and
" the Ordinance " means, tjhe Motor Traffic Ordinance 1932, &a amended from time to.'time. '. PART II.—INSURANCE.

6.—(1.) The owner of • an omnibus, in respect of which a licence to conduct an omnibus service is applied for,'shall insure himself and, at all times during the currency of the certificate of registration of the omnibus, keep himself insured in an insurance company approved by the Minister, against all sums for which he may become liable by way of damages in respect- of the omnibus in case of injury to persons.

A licence or a renewal of a licence to conduct an omnibus service shall not bo issued unless and until the applicant has obtained and deposited with the Registrar a policy of insurance in a form approved by the Minister insuring him' against, his liability for third party and passenger risks in respect of each omnibus to be employed in the service to an amount not. less than Two thousand five hundred .pounds.

by way of damages in respect of all his omnibuses in case of injury to persona, the Registrar may accept the policy as a sufficient compliance with the foregoing provisions of this Pa r t .
9. Every policy of insurance effected under, this P a r t shall be framing or
framed so as to insure the owner for the time being of the omnibus specified in the policy against all claims for injuries to persons arising out of the use of the omnibus during the period stated in the policy.
10. Nothing in this P a r t shall affect the liability of . the owner Common iuw
of an omnibus at Common Law by way of damages in respect of such ,a y ' omnibus in the case of injury to persona or property. 11. A policy of \nsurance effected in pursuance of this P a r t shall Policy not to

13. Any person who— obtaining (a ) for the purpose of obtaining a policy of insurance required false by this P a r t makes any false statement in,, consequence " a omeD ' whereof the policy is liable to be avoided; or (b) being the owner of an omnibus, commits an act which dis-
entitles him to claim under the policy,
shall be guilty of an offence. .. 14. The premium receipt with respect to the renewal of any policy Premium

PART I I I . — M O T O R OMNIBUS PASSENGER SERVICES.
15.—(1.) The licensee of an omnibus service shall publish for sale publication of
or free distribution to the public every time-table specified in the service M"«u>-tabie.

16. The Registrar may, subject to the Ordinance, grant to the owner j>ermitato

(ft) a permit for the omnibus, to follow, for such' period as is
stated in the permit, a rdute other than that to be followed in pursuance of the service licence;
(&) a permit to vary the time-table to be observed by the
omnibus for such period as is specified in the permit.
17. Any licensee who, without lawful excuse, causes or permits an j,iCenBCcto
omnibus engaged in the omnibus service to follow a route other than adhere to

other than that specified in the service licence, shall be guilty of an
offence. '>
18. Any licensee who, without reasonable excuse, withdraws any omnibus not
omnibus from a route specified in the service licence so as. to interfere withdrawn
with the. time-table specified in the licence for that route, shall be guilty from specifiedof an offence.
19. The licensee of' an omnibus service shall paint, or cause to be owner to
painted in legible letters, or display or cause to be-displayed, ih s u c h ' ^ ^ ^ manner as the Registrar thinks fit, in a conspicuous place .on the inside if required.' and outside of every omnibus employed in ' the service such particulars
as the Registrar requires as to the time-table for the service, the fares payable for travelling in or upon the omnibus, the route of the omnibus, and the places or areas specified tin the service licence at or within which passengers may- not be taken u p or set dowm
Omnibus rial ' to be altered. 20.™(1.) A licensee Shall iiot knowingly allow an omnibus on his service to be altered in any .material particular without first obtaining the permission' of the Registrar. - (2.) In the absence of proof to the contrary, any such alteration
. shall he deemed to have been made .with the knowledge of the'licensee.
TickeU. ,. • %%,—r(l.) The licensee' of an/omnibus service shall furnish tickets to
the conductor of every omnibus on the service'.
(2.) Each ticket shall show thefeon—
(a)' the name of the licensee;
(b) the route or section covered; and
(c) the fare payable, ••. : '•• and shall be numbered.consecutively.
(3,) The conductor shall issue to every passenger who pays the
fare payable the proper ticket in acknowledgment of the payment of the
f&re. . • [_. " (4.) A conductor shall, Upon receiving money from any passenger of a greater value than the amount of the fare for ihe journey of seotion of the' journey upon which the passenger' is then proceeding, immediately hand to that passenger the amount,of change to which he

Conductor to 23. A conductor shall, as far as .practicable, give to any person, give inloimntlon upon-request, information as to'aiiy matter concerning the route, fares to public. and time-table of the omnibus. Advertisements 24. A licensee shall not display or cause or permit to he displayed not to be
displayed. TO. upon the outside 'of any omnibus any advertisement other than the omnlbui..

Advertisement* 25. A licensee— ' . within
omnlbusei. (a) shall not display or eaUse or permit to be displayed within
. any omnibus any advertisement which is of such dimen- sions or character as to cause inconvenience to passengers 'or which is of glass; (b) shall not display any advertisement on any window or glass
•partition in any omnibus;
(c) shall not display any advertisement within any omnibus so as to conceal or obliterate any writing or number-plate required by; the Ordinance or these Regulations to be placed within the Omnibus;
• (d) shall ensure that any advertisement on enamelware, iron-
: ware or tiriplate displayed within an omnibus is fixed in such a manner that it cannot become loose to the risk
or danger of any passenger; :" (e) shall not hasp, or 'cause" or permit to'be hasped, any adver- tisement op the 'woodwork, sides or roof of any omnibus; and
(/) shall cause every advertisement to be held in a suitable frame which is without glass and so constructed as to be readily opened and closed, for the insertion or-removal of adver- tisements!

28. An applicant for a licence to drive a motor omnibus shall prove Qualifications
to the satisfaction of the Registrar, that he is— ,-,, omnibus!."̂ .-.

29/. Before the grant of a licence; td drive ari omnibus, a certificate ccrttfl<»tes
of fitness and a certificate of competency, shall be given by a testing and
officer and the applicant shall; answer in writing the questions required compet™cy:by the Registrar to be answered', and shall sign his name thereto in
the presence of the Registrar. • • 30. An applicant for a licence to drive an omnibus shall submit to certificates the Registrar a certificate of character signed by two persons of good character, repute approved by the Registrar.
31.-r-(l.) Every application for a licence or'the renewal of a licence Medical
as a driver of an omnibus shall be accompanied by a medical, certificate of omnibua
given by a medical testing officer. ,. .: drlvers- (2.) If at any time it appears to the Registrar that any person who is licensed as a driver of an omnibus is, by. reason of physical infirmity, or for other sufficient physical cause, unfit to be so licensed, the Registrar.may require that.person forthwith to submit himself for medical examination to a medical testing.officer.
Division 2.—Licensing of Conductors. '
32.—r(l.) A person shall not act as a conductor unless he holds a conductor* conductor's licence. . • licensed. (2.) The owner of an omnibus shall, before employing any person as a conductor, satisfy himself that that person holds- a conductor's licence.
33. An applicant for a conductor's licence shall prove to the satis- Qualification- •

34. An applicant for a conductor's licence shall submit to the Certificate as Registrar a certificate of character signed by two persons of good repute

37. The Registrar may-cancel.iOr suspend, for. such period as he Cancellation or

conductor in the course of his duties; or
(6) upon the conviction of the conductor of any offerifio which
seriously reflects upon his character as a fit and proper '..;. person to hold a conductor's- licence. :,"-'"

40.—(1.) The Registrar shall issue to every licensed driver and conductor of an omnibus a metal badge, having thereon a representation of the Canberra Goat of Arms; the registration number of the licence and such other particulars as the Registrar thinks proper.
conductors' badges. (2.) Every driver and conductor shall, at all times whilst driving
or conducting an omnibus, d/splay the 'badge upon the band of his
cap or upon the lapel of his outer coat in such a manner as to -bo
readily seen. , (3.) Within three days of the date of expiry of the period for which the. badge was issued, or the date of the cancellation or suspension of the licence held by the person in whose name the badge was issued, • that person shall re turn the badge to the Registrar.
(4.) Where a badge is required to be returned to the Registrar in pursuance of this regulation and is not so returned or is, when so returned, so defaced as, in the opinion of the Registrar} to be of. no further use, the person to whom the badge was issued shall pay to the Commonwealth the sum of Five shillings, and that sum shall be recover- able as a debt due to the Commpnivealth in any Court of competent jurisdiction.
(5.) Where a badge is lost, destroyed, or so damaged or defaced as to be of no further use, the person to whom the badge was issued shall notify the Registrar, and, in the case of loss or destruction, forward to the Registrar a statutory declaration of the loss or des t ruct ion/and the Registrar shall, if satisfied that no improper use has been made of the badge, and on payment of the sum of Five shillings,
•supply the person with a new badge. .' •
(6.)- A badge shall not be transferable and any unauthorized person who wears a badge shall be guilty, of an offence.

41.—(1.) When any omnibus has stopped for the purpose of taking until directed to do so by the conductor (if any) who shall communicate such direction by means of a -whistle or some other signal approved by
omnibus on up or setting down passengers, the driver shall not re-start the omnibus signal of conductor.

45. The'driver of an omnibus shall not, during any journey, cause be upon any portion of the omnibus on the right hand side of the driver's seat and abreast thereof, or upon any portion of the omnibus

in front of the driver's seat; - " Passengers not to be 46. The driver or conductor of an omnibus shall not— carried on step, &c. (a ) cause or permit any passenger to be carried outside the
omnibus or upon any step or stairway thereof or any
• portion thereof other than that set aside for passengers;
(b) wilfully deceive or refuse to inform any passenger or intend-
ing passenger as to the destination of the omnibus or theroute by which i t will proceed to such destination; or •
(c)
suffer or permit any passenger to smoke in or upon the ' omnibus except in that portion thereof (if any) which is
set apart for the purpose.
47. The'driver of an omnibus shall-—• Journey to
(a) start the omnibus from ona : of the places specified in the according to service licence for the route upon which the omnibus is Uconca\ ..',' authorized to bo used; (b) keep to the route specified in the service licence;' and
(c) complete the journey and the parts, thereof respectively in
the times specified in the ^service licence for the route
upon which the omnibus ?s 'authorized to be used.
48. The conductor of an omnibus shall not cause or permit any carriage of
person to bring or place thereon any animal. animals. 49. A conductor shall' not moisten his fingers with saliva before Conductor not

50. The driver or conductor of an omnibus shall not— ' ' conducto«
(a) smoke whilst the vehicle is conveying.any passengers; '. conductor* (6) cause annoyance to any' person by importuning that person or any other person to become a'passenger in the omnibus; (c) leave the omnibus to to,ut for,passengers; or
(d) endeavour to attract notice by whistling, shouting or calling.51. The driver and.conductor of an omnibus shall, whilst on duty— Rules as to .

54. The driver of an omnibus upon any public street shall, when not Driven to.

disease or illness; carried. (b) any person who is drunk or dirty, or .so attired as to cause annoyance to any other passenger, or to be likely to soil or damage the omnibus or the apparel of any other passenger; or
(c) any person who is noisy or violent, or misbehaving, or
disturbing the'public peace.
(2.) I t shall not be an offence to convey a person referred to in
paragraph (c) of the last preceding sub-regulation to a Police Station. 56. The conductor of an omnibus shall not permit any person to offensive
place or carry thereon anysiibstance of an offensive character or of such 4c.! not to be
dimensions as to inconvenience any passenger-', or any substance which carried,may soil or damage the omnibus or the apparel of any passenger.
57. If the breach or non-obsorvance of any of these Regulations is Breach of

P A S T V.-—OFFENCES BY PASSENGERS AND OTHER PERSONS. .
58.—(1.) Every passenger on. an omnibus shall pay the fare payable raymentof
by him either in cash'or by concession or other card or ticket purchased " or obtained from the licensee or his" agent or servant;

. (a) refuses or fails to pay the . fare payable by him when

• • (b) avoids or attempts to avoid payment-of airy fare payable
by h im; - (c) having paid his fare fo!r travelling pver a oertain seation, knowingly proceeds in the omnibus beyond the limits of that s,ectio.n and does not pay the fare payable in respect of the additional distance,
shall be guilty of an offence.
(3.) For the purposes of this regulation, one child under the ageof five years carried on the lap. o'f a passenger shall not be deemed to
be a passenger'. . '' ' " • ' • • .

exhibited on 59.—(1.) A passenger on an omnibus shall, upon demand by the conductor, or by any other person authorized by the licensee, or by any .; member of the Police Force, or any officer, acting in the execution of ..his duty, exhibit or deliver the ticket issued to him by the oonduotor for the journey or section of the (journey for which the passenger has v paid. demand. (2.) If the ticket is not produced when so demanded, the passenger shall, upon demand by the conductor, pay the fare payable for the journey upon which the passenger is then proceeding from the place at which the passenger entered the omnibus. delivery of Tender or 60.'—:(1.) (2.) Any such ticket so tendered shall not be accepted by the con- ductor and the passenger tendering the ticket shall be deemed not to have paid his fare, and shall, upon demand by the conductor, pay the fare payable for the journey upon which the passenger is then proceeding. • •
Passenger* 61. Except in the course of his duty under the Ordinance or these only allowed on omnibus. Regulations, a person, other than a passenger or intending passenger,
shall not enter or go upon any omnibus.Expectoration. 62. A person shall not expectorate upon the floor or any other part of an omnibus. Standing on 63.
