Motor Omnibus Fares Regulations2

(Amendment)

I, MICHAEL JOHN DUFFY, the Minister of State for Communications, acting for and on behalf of the Minister of State for Territories, hereby make the following Regulations under the Motor Omnibus Services Ordinance 1955.

Commencement

1. These Regulations shall come into operation on 15 March 1985.

Principal Regulations

2. In these Regulations, "Principal Regulations" means the Motor

Omnibus Fares Regulations.

Interpretation

3. Regulation 3 of the Principal Regulations is amended by inserting after

the definition of "journey" the following definition:

" 'peak-period journey' means a journey commencing not later than 9 a.m.

on a day other than a Saturday, Sunday or holiday;".

4. Regulation 4 of the Principal Regulations is repealed and the following

sub-regulation (3) and substituting the following sub-regulation:

Ordinary fares

"4. Subject to these Regulations, the fare to be charged in respect of a

journey is the amount calculated by multiplying—

(a) in the case of a peak-period journey—70 cents;
(b) in any other case—60 cents,

by the number equal to the number of sections of which the journey consists.".

Prices for books of tickets

5. Regulation 6D of the Principal Regulations is amended by omitting

Motor Omnibus Fares 1985 No. 7 695

"(3) For the purposes of sub-section 4CA (3) of the Ordinance, the price prescribed in relation to each of the classes of persons specified in sub-regulation (2) is—

(a) for a book of 10 tickets—$2.50;
(b) for a book of 20 tickets—$5.00; and
(c) for a book of 50 tickets—$ 12.50.".

Concession fares

6. Regulation 9 of the Principal Regulations is amended by omitting

sub-regulation (1) and substituting the following sub-regulation:
"(1) Subject to sub-regulation (3), the fare to be charged in respect of a journey on an omnibus by a person who is a pensioner, special beneficiary or dependent spouse, being a journey in respect of which the full fare would, but for this sub-regulation, be payable, is the sum calculated by multiplying—

(a) in the case of a peak-period journey—30 cents;
(b) in any other case— 10 cents,

by the number equal to the number of sections of which the journey consists.".

Exemptions

7. Regulation 10 of the Principal Regulations is amended—

(a)

by omitting from sub-regulation (1) ", 11 or 11 A" and substituting "or 11";

(b)

by adding at the end of paragraph (1) (b) "and, where that person (being a totally and permanently incapacitated returned soldier) is accompanied by an attendant, the attendant"; and

(c)

by omitting sub-regulation (3) and substituting the following sub-regulation:

"(3) In this regulation—

'incapacitated returned soldier' means a person who is in receipt of a

pension under the Repatriation Act 1920, the Repatriation

East Strategic Reserve) Act 1956 in respect of an incapacity, (Special Overseas Service) Act 1962 or the Repatriation (Far being total incapacity for the purposes of the Repatriation Act

1920, an incapacity of a kind referred to in Schedule 4 to the Repatriation Act 1920 or such other serious incapacity as the Minister approves for the purposes of this regulation;

'totally and permanently incapacitated returned soldier' means a

person who is in receipt of a special pension prescribed in

Schedule 2 to the Repatriation Act 1920".

Repeal of regulation 11A

8. Regulation 11A of the Principal Regulations is repealed.

Further amendments

9.  The Principal Regulations are amended as set out in the Schedule.
