Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Motor Dealers and Repairers Act 2013.

Explanatory note

The object of this Regulation is to prescribe—

(a) electrical accessory fitting work, exhaust repair work, glazing work, radiator repair work and steering, suspension and wheel alignment work as classes of repair work, and
(b) the qualifications required for each of those classes of repair work.

This Regulation is made under the Motor Dealers and Repairers Act 2013, including sections 6(2) (the definition of repair work), 26(2) and 186 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Motor Dealers and Repairers Amendment (Tradesperson’s

Certificates) Regulation 2020.

2      Commencement

This Regulation commences on 1 September 2020 and is required to be published on the NSW legislation website.

Regulation 2014

[1]      Clause 34 Classes of repair work

Insert after clause 34(c)—

(c1) electrical accessory fitting work—being the work carried out by
persons who install or remove electrical accessories in or from motor
vehicles, but does not include—
(i) work that involves cutting, splicing or altering wiring harnesses, or
(ii) work carried out on hybrid or electrically powered motor vehicles,
(c2) exhaust repair work—being the work carried out by persons who
fabricate, modify, service or repair the exhaust systems of motor
vehicles, but does not include—
(i) work on the chassis of motor vehicles, or
(ii) work carried out on hybrid or electrically powered motor vehicles,
(c3) glazing work—being the work carried out by persons who install,
repair or remove windscreens or other glass in or from the bodies of motor vehicles, but does not include work carried out on hybrid or electrically powered motor vehicles,

[2]      Clause 34(h1) and (h2)

Insert after clause 34(h)—

(h1) radiator repair work—being the work carried out by persons who
repair the radiators, heating equipment, thermostats or fuel tanks of motor vehicles, but does not include work carried out on hybrid or electrically powered motor vehicles,
(h2) steering, suspension and wheel alignment work—being the work
carried out by persons to—
(i) service or repair the steering or suspension systems of motor vehicles, or
(ii) balance or align the wheels of motor vehicles,
but does not include work carried out on hybrid or electrically powered
motor vehicles.

[3]      Clause 34(2)

Insert at the end of the clause—

(2) In this clause—
splicing means joining two or more wires, or parts of a wire, in a manner that
creates a permanent electric current.
wiring harness means a group of wires, cables or connectors that transmit
signals or electric power.

[4]      Clause 36 Required qualifications for tradesperson’s certificate

(c1) for electrical accessory fitting work—Certificate II in Automotive Electrical Technology, being part of the Automotive Industry Retail, Service and Repair Training Package,
(c2) for exhaust repair work—
(i) Certificate II in Automotive Underbody Technology, being part of the Automotive Industry Retail, Service and Repair Training Package, or
(ii) Certificate II in Automotive Exhaust System Technology, being part of the Automotive Industry Retail, Service and Repair Training Package,

(c3) for glazing work—Certificate II in Automotive Body Repair Technology, including the Automotive Glazing specialist elective units from the Automotive Industry Retail, Service and Repair Training Package,

[5]      Clause 36(1)(h1) and (h2)

Insert after clause 36(1)(h)—

(h1) for radiator repair work—Certificate II in Automotive Cooling System Technology, being part of the Automotive Industry Retail, Service and Repair Training Package,
(h2) for steering, suspension and wheel alignment work—Certificate II in Automotive Steering and Suspension System Technology, being part of the Automotive Industry Retail, Service and Repair Training Package,
