His Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Motor Dealers and Repairers Act 2013.

Explanatory note
The object of this Regulation is to amend the Motor Dealers and Repairers Regulation 2014 as follows:
| (a) | to increase certain fees payable under the Motor Dealers and Repairers Act 2013 (the Act), |
| (b) | to remove an unnecessary provision about discounting for online transactions as the power to provide discounts for online transactions is already covered under section 13 (2) of the Licensing and Registration (Uniform Procedures) Act 2002 which applies under the Act. |
The fee increases are generally in line with movements in the Consumer Price Index (rounded to the nearest following same type of service in other administered licensing regulations:
dollar).
| (a) | the issue of a replacement tradesperson’s certificate, |
| (b) | the issue of a duplicate licence for motor dealers, motor vehicle repairers and motor vehicle recyclers. |
This Regulation is made under the Motor Dealers and Repairers Act 2013, including sections 21, 24, 34 (2),
36, 166, 177 (5) and 186 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Motor Dealers and Repairers Amendment (Fees) Regulation
2016.
2 Commencement
This Regulation commences on 1 July 2016 and is required to be published on the
NSW legislation website.

Note. This amount is consequently a processing fee for the purposes of Part 2 of the Licensing and Registration (Uniform Procedures) Act 2002. If an application is made by electronic communication, the processing fee is discounted (see section 13 of that Act). If an application is refused or withdrawn, the applicant is entitled to a refund of all fees paid, other than the processing fee (see section 22 of that Act).
