Regulation under the Motor Dealers and Repairers Act 2013.

Explanatory note
The object of this Regulation is to exempt persons from the need to hold a NSW motor dealer’s licence in
order to offer or display a motor vehicle for sale at the Lismore Outdoor Leisure Show to be held on 7–9 July
2017.

The exemption will have effect only for the duration of the show (7–9 July 2017) and applies to participation

in the trade show only to the extent that it involves advising persons with respect to the quality, performance
and characteristics of motor vehicles and making offers to, or receiving offers from, persons to enter into
agreements for the sale of motor vehicles (other than second-hand motor vehicles).
This Regulation is made under the Motor Dealers and Repairers Act 2013, including section 186 (2) (a).

1      Name of Regulation

This Regulation is the Motor Dealers and Repairers Amendment (Exemption for
Lismore Show) Regulation 2017.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Motor Dealers and Repairers Regulation 2014

Clause 5A

Insert after clause 5:

5A Temporary exemption: Lismore Outdoor Leisure Show

(1)

Section 11 of the Act does not apply to a person who carries on the business of a motor dealer in relation to the offer or display for sale of a motor vehicle at the Lismore Show, but only if the business carried on by the person while participating in the trade show is limited to the following:

(a)

advising persons with respect to the quality, performance and characteristics of motor vehicles,

(b)

making offers to, or receiving offers from, persons to enter into agreements for the sale of motor vehicles (other than second-hand motor vehicles).

(2) This clause is repealed on 11 July 2017.
(3) In this clause:
Lismore Show means the Outdoor Leisure Show held at the Lismore
Showground, Alexandra Parade, Lismore on 7–9 July 2017.
