MOTOR DEALERS ACT 1974 - ORDER
NEW SOUTH WALES

I, Rear Admiral PETER ROSS SINCLAIR, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 8 of the Motor Dealers Act 1974, make the Order set forth in the Schedule.

SCHEDULE
Commencement,
1. This Order commences on 3 October 1990.
Repeal
2. The Motor Dealers (Auctions) Exemption Order 1986 is
repealed.

Amendment
3. The Motor Dealers (Exemptions) Order 1986 is amended:
by omitting from clause 4 the word "vehicle-wrecker" wherever
occurring and by inserting instead the word "auto-dismantler";
by omitting from items 1-4 of the Table to clause 5 the matter
"22, 22A, 22C, 22D," wherever occurring and by inserting
instead the matter "21A, 21B,";
by inserting in item 2 of the Table to clause 5 after the matter
"25," the matter "27 (1),";
by omitting from the Table to clause 5 that part of item 6 that
appears in Column 1 of that Table and by inserting instead the
following matter:6. A motor vehicle the cash price of which exceeds the amount prescribed for the purposes of section 28 (3) (f) of the Act.
by omitting clause 6;
by inserting after clause 10 the following clause:
Limit on amount of claims against Compensation Fund 11. Section 40 (Claims against Fund) has effect in relation to a person who has incurred a loss which exceeds $30,000 but only in relation to that part of the loss which does not exceed $30,000.
