Amendment Order 2002

Motor Dealers Act 1974

MARIE BASHIR, Governor I, Professor Marie Bashir AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 8 of the Motor Dealers Act 1974, make the following Order.

Explanatory note

The objects of this Order are:

(a)

to make it clear that tractors are not included in exemptions relating to certain heavy machinery, and

(b)

to remove exemptions from requirements of the Motor Dealers Act 1974 for commercial vehicles that are intended for use, or are used, primarily for private purposes in relation to claims on the Motor Dealers Compensation Fund, and

(c)

to replace the current exemption for second-hand trail bikes from requirements of the Motor Dealers Act 1974 with an exemption for second-hand motor cycles that are of such a design as to be incapable of registration in New South Wales.

1     Name of Order

This Order is the Motor Dealers (Exemptions) Amendment

Order 2002.

2 Commencement

This Order commences on 1 July 2002.

3     Amendment of Motor Dealers (Exemptions) Order 1986

The Motor Dealers (Exemptions) Order 1986 is amended as set out in

Schedule 1.
