His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Motor Accidents Compensation Act 1999.

Explanatory note
The object of this Regulation is to make it clear that claims cannot be made against the Nominal Defendant in respect of motor accidents involving uninsured vehicles on the Mount Panorama Racing Circuit during the races proposed to be held on that circuit during the period commencing on 20 April 2000 and ending on 23 April 2000. During that period, the area concerned will be exempted from the road transport legislation by an order under that legislation. Claims against the Nominal Defendant are generally only available in respect of accidents on roads and road-related areas to which the road transport legislation applies.

This Regulation is made under the Motor Accidents Compensation Act 1999, including section 33 (4) (d) and section 228.

1     Name of Regulation

This Regulation is the Motor Accidents Compensation (No 2)
Amendment (Mount Panorama) Regulation 2000.

2 Amendment of Motor Accidents Compensation Regulation (No 2) 1999

The Motor Accidents Compensation Regulation (No 2) 1999 is amended by inserting after clause 16 the following clause:

16A Exemption with respect to Mount Panorama racing circuit

For the purposes of section 33 (4) (d) of the Act, there is no right of action against the Nominal Defendant under section 33 of the Act in respect of the use or operation of a vehicle in the area to which, and in the period during which, the road transport legislation does not apply by virtue of the Road Transport (Mount Panorama Racing Circuit) Order 2000 published in the Gazette on 7 April 2000.
