Amendment Order 2019

under the

Motor Accident Injuries Act 2017

I, the chief executive of the State Insurance Regulatory Authority, in pursuance of sections 3.9,

3.22 and 4.22 of the Motor Accident Injuries Act 2017, make the following Order.

Explanatory note

The object of this Order is to adjust, for the year commencing 1 October 2019—

(a)	the maximum amount of weekly statutory benefits that is payable to persons who have been injured as a consequence of a motor accident to which the Motor Accident Injuries Act 2017 (the Act) applies, and
(b)	the maximum amount of damages that may be awarded for non-economic loss to persons who have been injured as a consequence of a motor accident to which the Act applies.

Sections 3.9 and 4.22 of the Act require the State Insurance Regulatory Authority to declare the amounts on or before 1 October each year. The amounts are indexed by reference to movements in average weekly earnings. An amount specified in this Order applies to the exclusion of the corresponding amount specified in section 3.9 or 4.13 of the Act.

This Order also notifies the number that equates to the factor	----	used in the formula set out in section 3.22

of the Act for calculating the variation of the amount of a weekly payment of statutory benefits to be paid

to a person who has been injured in a motor accident to which the Act applies.

Section 3.22 of the Act also requires the amount of a weekly payment of statutory benefits to be varied on
1 April and 1 October each year.

1      Name of Order

This Order is the Motor Accident Injuries (Indexation) Amendment Order 2019.

2      Commencement

This Order commences on 1 October 2019 and is required to be published on the
NSW legislation website.
