1. I t shall be lawful for t he said Thomas Sutcliffe M o r t to make divert a l ter va ry and stop u p cer ta in roadways or s t reets s i tuate in the h a m l e t of Ba lma in nea r t h e city of Sydney aforesaid and which said roadways and streets a re s i tua ted in t he immedia te vicini ty of t h e said dry dock a t Ba lma in aforesaid and which said roadways or s t reets are par t icu la r ly set forth or described in Schedule B he reun to annexed and to subs t i tu te o ther roadways and s t reets in lieu thereof a n d also to t ake a n d appropr ia te to t h e use of t h e said Thomas Sutcliffe M o r t for t h e purposes of th i s A c t such lands only as are described in Schedule A to th i s Ac t toge the r w i th t h e sites of such roadways or s t reets or in tended roadways or s t reets or pa r t s thereof as are described in Schedule B he reun to annexed and such lands covered wi th wa te r lying be tween low water m a r k and t h e adjoining lands of t h e said Thomas Sutcliffe M o r t as are described in Schedule C he reun to annexed and for al l or any of t h e purposes aforesaid to t ake a n d appropr ia te t he several l ands a n d he red i t amen t s respect ively described in t h e several Schedules A B and C he r eun to annexed t h e said Thomas Sutcliffe M o r t if so requ i red m a k i n g full compensa t ion in m a n n e r hereinafter ment ioned to all persons in te res ted in any lands so t a k e n used or injured for all damages to be by t h e m susta ined in or by t h e execut ion of t he powers hereby gran ted .

4. A n d in case t he said Thomas Sutcliffe M o r t and t h e c la imant
of l and shal l no t agree as to t h e sum to be paid for such compensa t ion as aforesaid i t shall be lawful for t h e m or e i ther of t h e m w i t h i n t he space of six calendar m o n t h s from t h e pass ing of th is A c t t o app ly to H i s Excel lency the Governor to appoint and he shall there u p o n appoin t accordingly Commissioners to i nqu i r e in to and assess t h e same in l ike m a n n e r as is enacted and directed in t he case of a road t h r o u g h pr iva te p roper ty procla imed by the Government unde r a n d by v i r tue of an Ac t of t h e Governor and Legislat ive Council passed in t he four th year of t h e re ign of H i s la te Majesty K i n g

" and for opening and improving the Streets in the Towns thereof'' and for the purposes of such assessment t he said Commissioners or any two of t h e m shall have and possess all t h e powers vested in t h e m or any two of t h e m by t h e said A c t and t h e l ike duties powers and regula t ions shall a t t ach and apply to t he par t ies j u ro r s witnesses and o thers occupied and concerned in re la t ion there to and in case t he price assessed on such inqui ry be in excess of the sum offered as compensa t ion by the said Thomas Sutcliffe M o r t such excess shall be paid by the said Thomas Sutcliffe M o r t accordingly together wi th t he costs of i nqu i ry b u t if t h e price awarded upon the said inqu i ry shall no t exceed the s u m so offered as aforesaid t he costs of t h e inqu i ry shall be pa id by the par t ies demand ing t h e same t h e a m o u n t of which costs shall be assessed a n d t h e person or persons by and to w h o m the same shall bo paid shall be ascer ta ined by t h e order of t h e said Commis sioners and shall be recoverable by act ion of debt if no t paid on
