CaseChat Overview and Summary
The court was required to determine whether the agreement was a genuine enterprise agreement and whether it complied with the relevant statutory provisions. The key issue was whether the agreement met the requirements for a certified agreement, specifically whether the agreement had been negotiated in good faith and whether it complied with the procedural fairness requirement.
The court found that the agreement was a genuine enterprise agreement that had been negotiated in good faith. The court also found that the agreement complied with the statutory requirements, including the procedural fairness requirement. The court held that the FWC's approval of the agreement was valid, and the agreement was therefore approved as a certified agreement. The court held that the AMWU's opposition to the application was not well-founded, and the application was successful.
The court made an order approving the Morgan Technical Ceramics Australian Manufacturing Workers Union Workplace Agreement 2016 as a certified agreement under the Fair Work Act 2009. The court also ordered that the agreement be registered with the Fair Work Commission. The court further ordered that the costs of the application be paid by the applicant.
