Act No. 10, 1909.
An Act to sanction the construction of a line of
railway from Moree to Mungindi; to autho rise the construction of the said line on
public roads ; to amend the Public Works Act, 1900, so far as it relates to the making' and maintaining" of fences along the saidl ine ; to provide for the use of the said line
by the Constructing Authority or by persons authorised by him; and for other purposes consequent thereon or incidental thereto.

| a Bi l l into the said Assembly to sanction the carrying out of the said | |
| work : Be it therefore enacted by the King 's Most Excellent Majesty, by and with the advice and consent of the Legislat ive Council and Legis la t ive Assembly of New South Wales in Parl iament assembled, and by the authority of the same, as follows :— |
1. This Act may be cited as the " Moree to Mungindi Ra i lway
| Construction, and deposited in the public office of the said Secretary. |
| 4 . The cost of carrying out the said work, estimated at two |

2. The carrying out the said work (more particularly described
in the Schedule to this Act) is hereby sanctioned; and the Secretary for Public Works, or the member of the Executive Council for the time being performing the duties of tin; said Secretary, is hereby authorised to undertake and carry out the said work, subject to tin; provisions of this Act, and for that purpose shall be, and shall have the powers and duties of, Constructing Authority within the meaning of the Public Works Act, 1900.
3 . The plan of the said work is the plan marked "Moree to
Mungindi R a i l w a y , " signed by the Secretary for Public Works and countersigned by the Chief Engineer for Ra i lway and Tramway
hundred and eighty-nine thousand six hundred and forty-three pounds, shal l be defrayed from such Loan Votes as are now or may hereafter be applicable to that purpose, and shall not under any circumstances exceed the estimated cost by more than ten per centum.
5. The said line of ra i lway may be constructed on any public
road or highway.
6. Notwithstanding the provisions of section eighty-four of the Public Works Act, 1900, the Constructing Authori ty shall not be required or compelled, nor shall it be the duty of the said Authority, to make and maintain any fence along the said line of rai lway for the accommodation of any person, or for any purpose whatsoever; but the said Authority may, in his discretion, make and maintain such fences in connection with the said line of ra i lway as he may think lit.7 . The Constructing Authority, and any persons authorised by
him, may use the said line or any part thereof before it is transferred to the Chief Commissioner for R a i l w a y s and Tramways, and for that purpose may run thereon any carriages or wagons propelled or drawn by any motive power.

mi les 7 8 cha ins 694 l i n k s from Newcas t l e . C u r v i n g to the east from Moree i t
i m m e d i a t e l y crosses the M e h i R i v e r , a n d proceeds nor th -wes te r ly for about 0 mi les to the
southern b a n k of the G w y d i r R i v e r ; thence a no r the r ly course ca r r i e s i t across t h a t
r iver , 1/2 mi l e beyond which it bears nor th -wes te r ly and abou t 3 3 0 mi les passes through
the v i l l a g e of Bogree, or A s h l e y , and crosses M a r s h a l l ' s Ponds Creek , where the l ine deflects more to t he nor th and, at about 3 4 0 mi les , reaches \ V a l i e n Creek , the left bank
of which , a lso t he left bank of Gil Gil Creek , it c losely follows to Garah ; from there the
l ine passes close to the southern bounda ry of tha t town, and proceeds south-wes ter ly a n d
nor th -wes te r ly a long t r a v e l l i n g stock reserve No. l.~>,026 to, a p p r o x i m a t e l y , 1 mile beyond
the crossing of Gil Gil Creek : a n d thence i t bears wes t e r ly a long the nor thern side of
tha t creek, a n d t r ave r ses par t of t r a v e l l i n g stock reserve No. 26 ,225 to near the crossing
of W h a l a n Creek, whe re it t u r n s a g a i n nor th -wes te r ly , crosses W h a l a n Creek , as also
l 'oomi R i v e r a n d Goony Creek, and, about 2 mi les beyond the l a t t e r , ends on the left
bank of the B a r w o n River , a t the nor th-eas tern corner of the v i l l a g e of M u n g i n d i , a t
3 9 2 mi les 1 1 cha ins from N e w c a s t l e ; a n d sub jec t to such modifications a n d dev ia t ions a s
m a y be considered des i r ab le by the Cons t ruc t ing A u t h o r i t y .
