Preamble

WHEREAS by Order in Council dated 8th September 1964[1], certain Crown land known as Queens Park in the Parish of Doutta Galla was permanently reserved as a site for public park and public recreation:

AND WHEREAS the corporation of the city of Essendon is the committee of management of the said reserved land:

AND WHEREAS it is expedient to authorize the said corporation to grant leases in respect of that part of the reserved land delineated and shown hatched on the plan in the Schedule:

BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title

This Act may be cited as the Moonee Ponds (Queens Park) Land Act 1971.

2.Definition

In this Act "corporation" means the corporation of the city of Essendon.

3.Power to grant leases of land in Schedule

(1)Notwithstanding anything in any Act the corporation as committee of management may from time to time grant a lease of the whole or any part of the land delineated and shown hatched on the plan in the Schedule for the purpose of a bowling club for amusement and recreation and for amenities connected therewith including the erection of buildings for such purpose.

(2)A lease under this section—

(a)shall be subject to such covenants conditions exceptions and reservations as the corporation thinks fit;

(b)shall be for a term not exceeding twenty-one years; and

(c)shall be subject to approval by the Governor in Council.

(3)The moneys received by way of rent under any such lease shall be applied by the corporation towards the maintenance and improvement of the whole or any part of the aforementioned land permanently reserved by Order in Council dated 8th September, 1964 and not leased under this section or for any other purpose approved by the Minister.

(4)No compensation shall be payable by the Crown in respect of any act matter or thing done under or arising out of this section.

Land in the Parish of Doutta Galla in respect of which the corporation of the city of Essendon may grant leases for the purpose of a bowling club for amusement and recreation and for amenities connected therewith.

The Moonee Ponds (Queens Park) Land Act 1971 was assented to on 19 October 1971 and came into operation 19 October 1971.
