CaseChat Overview and Summary
The key legal issues before the Commission were whether the proposed agreement provided for terms and conditions that were at least as favourable as those provided for in the applicable award or registered agreement, and whether the agreement complied with the "better off overall test". This test requires that, on balance, the agreement must not be worse for employees than their previous terms and conditions. The Commission also needed to consider whether the agreement contained any provisions that were contrary to public policy or that might otherwise be unenforceable.
In delivering its decision, the Commission carefully considered the evidence and arguments presented by both parties. The Commission found that the proposed agreement met the requirements of the Fair Work Act. It provided for terms and conditions that were at least as favourable as those provided for in the applicable award or registered agreement. Furthermore, the Commission was satisfied that the agreement complied with the "better off overall test" and did not contain any provisions that were contrary to public policy or otherwise unenforceable. As a result, the Commission approved the Montegar Constructions Enterprise Agreement 2023.
The Commission's decision was a significant win for Montegar Constructions, as it provided the company with the flexibility to manage its workforce under the terms of the new agreement. The final orders of the Commission were that the Montegar Constructions Enterprise Agreement 2023 be approved as a registered agreement, effective from the date of the decision.
