JUSTICE BOULTON, SENIOR DEPUTY PRESIDENT
SENIOR DEPUTY PRESIDENT HARRISON
COMMISSIONER ROE

SYDNEY, 18 FEBRUARY 2013

[1] On 17 December 2012, in accordance with the Full Bench’s previous Statement and Directions ([2012] FWAFB 10395), the Australian Council of Trade Unions (ACTU) provided a list of matters before the Full Bench that are to be regarded as common matters.

[2] Correspondence has been received from the Department of Education, Employment and Workplace Relations (DEEWR), Housing Industry Australia (HIA) and the Master Plumbers Association of New South Wales (MPA) regarding a range of issues relating to the ACTU list and the determination of other matters.

[3] The Full Bench is proceeding on the basis that the list of common matters set out in the ACTU document is the complete list of such matters to be dealt with in the scheduled proceedings.

[4] The only party which has suggested that other matters should be included as common matters is DEEWR, in a letter dated 14 December 2012. In the proceedings on 4-6 March 2013, the Bench will hear and determine any application to expand the ACTU list of common matters. The Bench will also consider setting a timetable for the hearing and determination of the matters which are raised in the various applications which are not being dealt with as common matters, as well as a timetable for the hearing and determination of additional common matters (if any).

[5] As previously advised, the Full Bench does not intend to make use of videoconferencing facilities for the purposes of the hearings. The Full Bench will give consideration to any application for the hearing by video link of the submissions of an interested party who is unable for good reason to attend the listed hearings.
