[1] On 18 March 2013, the Fair Work Commission (the Commission) received correspondence from the Australian Industry Group requesting that the Full Bench not proceed to the hearing of submissions in the review on 4-5 April. This request was broadly supported by the union and employer parties to the proceedings.

[2] Having taken into account the views of the parties, the Full Bench will proceed with the review as follows:

  • The hearing on 4 April 2013 is to be used for the hearing of any remaining witness evidence, including the hearing by video link of witnesses who were not able to testify in Adelaide or Melbourne.


  • The listed date of 5 April will be used to convene a conference of the parties to explore whether any of the issues in the review may be resolved prior to the presentation of submissions.


  • The Full Bench will sit in Sydney on 22-24 April and 1-3 May in order to hear the submissions of the parties.


[3] In relation to the making of submissions, the following directions are made:

  • Before commencing their oral submissions, parties are to provide three copies of a short written outline of submissions (no more than 10 pages double spaced) to the Commission, with copies to the other parties, drawing particular attention to the most important parts of their submissions and witness evidence.
