[1] On 5 April 2013, the Full Bench convened a conference of the major parties to the review. At the conclusion of the conference, the Full Bench advised the parties as to the following matters:
- Apart from the hearing dates of 22 to 24 April 2013 (submissions from applicant unions etc) and 1 to 3 May 2013 (submissions from employers etc), the Full Bench has set aside 8 and 9 May 2013 for the hearing of reply submissions.
- The application by the Shop, Distributive and Allied Employees Association in relation to the General Retail Industry Award 2010 (AM2012/196) seeking adult rates for employees 20 years of age will be listed for mention and programming in Sydney at 9:00 am, Tuesday 23 April 2013.
- In relation to matters before the Full Bench which have not been designated as common matters, the parties may advise the Full Bench if an expedited determination is sought. This should be done in writing and include the reasons for the request. The request should also include advice as to whether the parties to the relevant award have conferred regarding the proposed award variations and the extent of any agreement reached.
- The application by the Master Plumbers and Mechanical Contractors Association of New South Wales to include a provision in the Plumbing and Fire Sprinklers Award 2010 for “elite sports apprentices” has not been designated as a common matter and will be dealt with accordingly.
[2] We continue to encourage the parties to confer regarding the matters in the review and to explore whether there is scope for agreement to be reached on the matters.
