Act of 1884," A n d whereas by t h e second section of t h e said A c t i t was provided t h a t t he Ra i lway the reby au thor ized to be constructed by t h e M i t t a g o n g Coal -mining Company Limi ted should be con­ s t ruc ted and b rough t in to use wi th in two years after t he passing such A c t A n d whereas i t is expedient fu r the r to ex tend the t ime l imited by such section for t h e const ruct ion of t he said rai lway and in o ther respects to a m e n d t h e said A c t Be i t therefore enacted b y t h e Queen 's Most Exce l l en t Majes ty b y and wi th t he advice a n d consent of the Legislat ive Counci l and Legis la t ive Assembly of N e w South Wales in P a r l i a m e n t assembled and by the au tho r i t y of t h e same as follows :—

1.    The t ime l imited by the said reci ted A c t for the cons t ruc t ion

of t he said Ra i lway shal l be ex tended beyond t h e t ime the reby l imited

n a m e l y for t h e t e rm of two years after t he pass ing of this Act .

2. I t shall be lawful for t h e M i t t a g o n g Coal-mining Company
L imi ted hereinafter called t h e Company to cons t ruct t h e Ra i lway

ment ioned in t h e said reci ted A c t t h r o u g h t h e lands k n o w n as port ions one seven e ight n ine a n d ten Woodlands sub-division ment ioned in the Schedule to t h e said recited Ac t a l t hough such lands are no t men t ioned in first section of t he said recited Ac t .

3. The th i rd section of t h e said reci ted A c t shall be read and
cons t rued as if t he words " one hund red " h a d been inser ted in l ieu of

t h e words " th i r ty-s ix " in t h e t en th l ine of such section and as if t h e words " th ree halfpence " had been inserted in l ieu of t h e words " one

halfpenny " in t he t h i r t e e n t h l ine of such section.
4. No twi ths t and ing a n y t h i n g contained in t h e said th i rd section

of t he said reci ted A c t i t shal l be lawful for t he Company to recover compensat ion in respect of t he consequent ia l damage if any sustained by reason of the suspension of t rans i t i n t h e said ra i lway in t he even t of t h e ra i lway being damaged by persons who shall themselves use t h e ra i lway for t rans i t and supply locomotive power.

5. The twen ty - seven th section of t h e said reci ted A c t shal l be

read and construed as if t he word " c l a i m e d " h a d been inser ted in

l ieu of t h e words " so offered " in t h e seventh l ine of such section.

6. This A c t m a y be cited as t h e " M i t t a g o n g Coal -mining
Company ' s Ra i lway A c t A m e n d m e n t Ac t of 1887 ."
