Misuse of Drugs Order 2015

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 40 of the Misuse of Drugs Act 2001 .13 April 2015

1Short titleThis order may be cited as the Misuse of Drugs Order 2015 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal ActIn this order, the Misuse of Drugs Act 2001 is referred to as the Principal Act. 4Schedule 1 amended (Controlled substances and trafficable quantities) Part 2 of Schedule 1 to the Principal Act is amended as follows: (a) by inserting after item 10 the following item:

10A.  Allylescaline

(b) by omitting items 29B and 29C and substituting the following items:

29B.	1-benzofuran-5-ylpropan-2-amine (otherwise known as 5-(2-aminopropyl)benzofuran or 5-APB)	25g or 20 units
29C.	1-benzofuran-6-ylpropan-2-amine (otherwise known as 6-(2-aminopropyl)benzofuran or 6-APB)	25g or 20 units

(c) by omitting item 45 ; (d) by omitting item 60 ; (e) by omitting items 85A and 85B and substituting the following items:

85A.	1-(2,3-dihydro-1-benzofuran-5-yl)propan-2-amine (otherwise known as 5-(2-aminopropyl)-2,3-dihydrobenzofuran or 5-APDB)	25g or 20 units
85B.	1-(2,3-dihydro-1-benzofuran-6-yl)propan-2-amine (otherwise known as 6-(2-aminopropyl)-2,3-dihydrobenzofuran or 6-APDB)	25g or 20 units

(f) by inserting after item 99 the following item:

99A.  2-(2,5-dimethoxyphenyl)-N-(2-methoxybenzyl)ethanamine (otherwise known as 25H-NBOMe)

(g) by inserting after item 106 the following item:

106A.  1-(1,2-diphenylethyl)piperidine (otherwise known as diphenidine)

(h) by inserting after item 120 the following item:

120A.  Ethylphenidate

(i) by omitting item 139 ; (j) by inserting after item 162 the following item:

162AA.  Methoxetamine

(k) by omitting item 208 ; (l) by omitting item 239 ; (m) by omitting item 239A and substituting the following item:

239A.  1-phenyl-2-(1-pyrrolidinyl)-1-pentanone (otherwise known as α-pyrrolidiniopentiophenone or α-PVP) 25 grams (or 20 units)

EXPLANATORY NOTE

(This note is not part of the order) This order amends the

(a) removing certain superseded references from the list of controlled drugs; and (b) adding certain substances to the list of controlled drugs; and (c) correcting certain references on the list of controlled drugs.
