Misuse of Drugs Order 2002

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 40(3) of the Misuse of Drugs Act 2001 .23 September 2002

1Short titleThis order may be cited as the Misuse of Drugs Order 2002 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Misuse of Drugs Act 2001 amended Schedule 1 to the Misuse of Drugs Act 2001 is amended as follows: (a) by inserting after item 74 in Part 2 the following:

Darbepoetin alfa

(b) by omitting item 112 from Part 2 and substituting the following:

Ephedrine (S4)

(c) by inserting after item 113 in Part 2 the following:

113D. 

Erythropoietins

(d) by omitting item 248 from Part 2 and substituting the following:

Pseudoephedrine (S4)

(e) by inserting after item 255 in Part 2 the following:

255M. 

Salvinorin A

(f) by inserting after item 8 in Part 3 the following:

9. 

Salvia divinorum

Displayed and numbered in accordance with the Rules Publication Act 1953.

This order is administered in the Department of Justice and Industrial Relations.

EXPLANATORY NOTE

(This note is not part of the order) This order amends Schedule 1 to the

(a) updating and correcting the list of controlled drugs; and (b) adding salvia divinorum to the list of controlled plants.
