Misuse of Drugs Act 1981

Misuse of Drugs Amendment Regulations 2012

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Misuse of Drugs Amendment
Regulations 2012.

2.             Commencement

These regulations come into operation as follows —

(a)

regulations 1 and 2 — on the day on which these regulations are published in the Gazette;

(b)

the rest of the regulations — on the day on which the Misuse of Drugs Amendment Act 2011 section 6 comes into operation.

3.             Regulations amended

These regulations amend the Misuse of Drugs Regulations 1982.

4.             Regulation 4B inserted

After regulation 4A insert:

4B. Drug paraphernalia: prescribed things and
circumstances (Act s. 7B(5))
(1) In this regulation —
approved means approved by the CEO;
CEO has the meaning given in the Health Legislation
Administration Act 1984 section 3;
needle and syringe programme has the meaning given
in the Poisons Act 1964 section 5(1).
(2) For the purposes of section 7B(5)(b) of the Act, the
following things are prescribed —

(a) shishas; (b) hookahs.

(3) For the purposes of section 7B(5)(c) of the Act, the
display or sale of drug paraphernalia in the course of
the conduct of an approved needle and syringe
programme is prescribed.

5.             Regulation 6A deleted

Delete regulation 6A.
