Misuse of Drugs Amendment Regulations 2010

Made by the Governor in Executive Council.

I.            Citation

These regulations are the Misuse of Drugs Amendment

1266 GOVERNMENT GAZETTE, WA 30 March 2010

2.            Commencement

These regulations come into operation as follows -

(a) regulations 1 and 2 - on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations - on the day after that day.

3.           Regulations amended

These regulations amend the Misuse of Drugs Regulations 1982.

4.           Regulation 7 amended

(1) In regulation 7(1):

(a) delete "section 27," and insert:

sections 27 and 28,

(b) delete "substance" (first occurrence) and insert:
substance, or a thing (other than a prohibited drug,
prohibited plant or dangerous substance) (other thing),
(c) in paragraph (a) delete "substance;" and insert: substance, or other thing;
(d) delete paragraph (b) and insert:

(b) in the presence of 2 witnesses from 2 of the

following classes of persons (but not so that the
2 witnesses are persons from the classes

referred to in subparagraphs (i) and (iii)) -

(1) a police officer who is a commissioned

officer appointed under the Police
Act 1892 section 6;

(ii)     a justice of the peace or a registrar of the Magistrates Court, other than a registrar of the Magistrates Court who is a police officer;

(iii)     a police officer appointed under the Police Act 1892 section 7 nominated in writing by a police officer referred to in subparagraph (1);

(iv)     an approved analyst or an approved botanist.

(2) In regulation 7(2) delete "substance" and insert:

substance, or other thing,

5.            Regulation 9 deleted

Delete regulation 9.
