Act No. 158, 1985

An Act to amend certain Acts with respect to the maintenance of accounts

in the Special Deposits Account in the Treasury. [Assented to, 28th

November, 1985.]

Miscellaneous Acts (Special Deposits Account) Amendment 1985

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

Short title

1. This Act may be cited as the "Miscellaneous Acts (Special Deposits

Account) Amendment Act 1985".
Commencement

(1) Sections 1 and 2 shall commence on the date of assent to this Act. (2) Except as provided by subsection (1), the several provisions of this Act shall commence on such day or days as may be appointed by the Governor and notified by proclamation published in the Gazette.

Amendments

1. Each Act specified in Schedule 1 is amended in the manner set forth

AMENDMENTS

Chipping Norton Lake Authority Act 1977 No. 38—

Section 20 (3)—

After section 20 (2), insert:

(3) On and from the day on which this subsection takes effect, the account established under subsection (1) shall be entitled the Chipping Norton Lake Authority Account.

Fish River Water Supply Administration Act 1945 No. 16—

(1) Sections 12(1), 13 (1)—

Omit "in the Special Deposits Account in the Treasury" wherever occurring.

(2) Section 1 3A—

After section 13, insert:

Accounts to be kept in Special Deposits Account

13A. The Working Account and the Renewal Reserve Account shall be kept

in the Special Deposits Account in the Treasury in an account to be called

the "Fish River Water Supply Account".

New South Wales Government Engineering and Shipbuilding Undertaking Act 1943 No.

19—

(1) Sections 8 (1), 9(1)—

Omit "in the Special Deposits Account in the Treasury," wherever occurring.

(2) Section 9A—

After section 9, insert:

Accounts to be kept in Special Deposits Account

9A. The Working Account and the Depreciation Reserve Account shall be kept in the Special Deposits Account in the Treasury in an account to be called the "New South Wales Government Engineering and Shipbuilding Undertaking Account".

South-west Tablelands Water Supply Administration Act 1941 No. 36—

(1) Sections 12(1), 13(1)—

Omit "in the Special Deposits Account in the Treasury" wherever occurring.

(2) Section 1 3A—

After section 13, insert:

Accounts to be kept in Special Deposits Account

1 3A. The Working Account and the Renewal Reserve Account shall be kept

in the Special Deposits Account in the Treasury in an account to be called
the "South-west Tablelands Water Supply Account".

State Brickworks Act 1946 No. 16—

(1) Sections 5 (1), 6 (1)—

Omit "in the Special Deposits Account in the Treasury" wherever occurring.

(2) Section 6 A —

After section 6, insert:

Accounts to be kept in Special Deposits Account

6A. The Working Account and the Depreciation Reserve Account shall be

kept in the Special Deposits Account in the Treasury in an account to be

called the "State Brickworks Account".

Suitors' Fund Act 1951 No. 3—

(1) Section 3(4)—

After "an account", insert "in the Attorney General's Department Account".

(2) Section 3 (5)—

Omit "such account", insert instead "the account first referred to in subsection

(4)".

TRANSITIONAL PROVISIONS

Construction of certain references

On and from the day on which the amendment by this Act of the Chipping Norton Lake Authority Act 1977 takes effect, a reference (however expressed) in any other Act (whether assented to before, on or after that day), or in any regulation, by-law or other

statutory instrument or in any other document, whether of the same or of a different kind, to the Chipping Norton Lake Authority Working Account shall be read and construed as a reference to the Chipping Norton Lake Authority Account.

Transfer of certain money
As soon as practicable after the day on which the amendment by this Act of the Suitors' Fund Act 1951 takes effect, the balance standing to the credit of the account which, immediately before that day, was required by section 3 (4) of that Act to be established in the Special Deposits Account in the Treasury shall be transferred to an account in the Attorney General's Department Account in the Special Deposits Account in accordance with that subsection, as amended by this Act, and the account from which the balance is transferred shall be closed.
