An Act to amend certain Acts as a consequence of the repeal of the Private Health Establishments Act 1982 and of the enactment of the Private Hospitals and Day Procedure Centres Act 1988 and the Nursing Homes Act 1988. [Assented to 30 December 1988]

Miscellaneous Acts (Private Health Establishments) Amendment 1988

The Legislature of New South Wales enacts:

Short title

1. This Act may be cited as the Miscellaneous Acts (Private Health

Establishments) Amendment Act 1988.

Commencement

2. This Act commences on a day or days to be appointed by

proclamation.

Amendment of Acts consequent on the repeal of the Private Health

Establishments Act 1982

3. Each Act specified in Schedule 1 is amended as set out in that

Schedule.

SCHEDULE 1—AMENDMENT OF ACTS

(Sec. 3)

Children (Care and Protection) Act 1987 No. 54—

Section 3(1), paragraph (a) (ii) of the definition of "exempt premises"—

Omit the subparagraph, insert instead:

(ii) a private hospital or day procedure centre licensed under the Private Hospitals and Day Procedure Centres Act 1988 or a nursing home licensed under the Nursing Homes Act 1988;

Disability Services and Guardianship Act 1987 No. 257—

Section 3(1), paragraph (a) (ii) of the definition of "exempt premises"—

Omit the subparagraph, insert instead:

(ii) a private hospital or day procedure centre licensed under the Private Hospitals and Day Procedure Centres Act 1988 or a nursing home licensed under the Nursing Homes Act 1988;

Medical Practitioners Act 1938 No. 37—

Section 27 (1), paragraph (cl) of the definition of "professional misconduct"—

Omit the paragraph, insert instead:

(cl) is convicted of an offence against section 46 of the Private Hospitals and Day Procedure Centres Act 1988 or section 43 of the Nursing Homes Act 1988 (which relate to disclosure of pecuniary interests to patients);

Summary Offences Act 1988 No. 25—

Section 3 (Definitions)—

(a) Section 3(1), paragraph (c) of the definition of "hospital"— Omit the paragraph, insert instead:
