502 { tteelt5tittt ANNO VICESIMO SEXTO ELIZABETHAE SECUNDAE REGINAE No, 50 of 1977 An Act to enable the budget of the Council of the Shire of Miriam Vale for the year ending 30 June 1978 to be framed and adopted afresh; to enable the Council to make and levy rates and charges that are founded thereon; and for purposes connected therewith [ASSENTED TO 6TH OCTOBER, 1977] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title. This Act may be cited as the Miriam Vale Shire Council Budget Enabling Act 1977. 2. Interpretation . (1) In this Act, unless the contrary intention appears- " the Act " means the Local Government Act 1936-1977; " budget " means budget for every fund established and kept by the Council pursuant to section 23 of the Act; "the Council" means the Council of the Shire of Miriam Vale constituted pursuant to the provisions of the Act. (2) Where in this Act a term is used that is not defined in this Act but is defined in the Act, such term, unless the contrary intention appears, shall have the meaning given to it by the definition in the Act.
Miriam Vale Shire Council Budget Enabling Act 1977, No. 50 503 3. Cessation of operation of Council ' s budget and rates and charges. (1) The budget adopted by the Council on 29 July 1977 for the year commencing 1 July 1977, pursuant to section 25 (3) of the Act, is hereby declared not to have any force or effect and never to have had any force or effect. (2) The rates and charges made by the Council on 29 July 1977 in respect of the year commencing 1 July 1977, pursuant to section 21 of the Act, and founded on the budget referred to in subsection (1) of this section are hereby declared not to have any force or effect and never to have had any force or effect. 4. Framing and adoption of new budget . (1) The Council shall frame and adopt, within 60 days after the commencement of this Act, a budget for the year commencing 1 July 1977. (2) Any ordinary disbursement of the Council in the period commencing 1 July 1977 and concluding on the day of adoption of such budget is authorized and shall be included in that budget. (3) Subject to the foregoing, the budget shall be framed and adopted in accordance with the Act. 5. Making and levying of rates and charges. The Council may make and levy, in respect of the year commencing 1 July 1977, rates and charges pursuant to section 21 of the Act, founded on the budget referred to in section 4 of this Act, and the provisions of the Act apply with respect to those rates and charges.
