An Act for appointing the Fees to be taken in the several Courts of Police and Pe t ty Ses­ sions and by the Clerks of Just ices act ing singly in the Colony of New South Wales. [16th July, 1833.]

WH E R E A S a t t h e several Police Offices and P e t t y Sessions and by t h e

it is expedient t h a t t he Fees to he t aken by t h e Clerks

Clerks of Magi s t r a t e s ac t ing singly in t h e Colony of N e w South W a l e s should be ascer tained and fixed Be it therefore enacted by H i s Excel lency t h e Governor of New South W a l e s wi th t h e advice of t h e Legis la t ive Counci l thereof Tha t from and after t h e pass ing of th is Act t he said Clerks respectively shal l a n d m a y demand receive and t ake t he several Fees specified in t he Schedule he reun to annexed m a r k e d A for t he business and services the re in s ta ted and by t h e m performed and if a t any t i m e hereafter any such Clerk or any person ac t ing as such shall under pre tence of any m a t t e r or t h i n g done t r ansac ted or performed by such person as Clerk demand or receive any other or greater Fee t h a n such as are specified and set forth in t h e said Schedule he shal l for every such offence forfeit and pay t h e sum of five pounds to he recovered in a s u m m a r y way before any one Jus t i ce of t h e Peace Provided always t h a t it shall he lawful for every Jus t i ce of t he Peace and he is requi red to adminis ter to any nava l or mi l i t a ry pensioner t he oa th or oaths necessary to be m a d e for t he receipt of his pension wi thou t any charge be ing made for t h e same.

2. A n d he it fur ther enacted Tha t t he Chief Clerk in every Police Office and Clerk to every P e t t y Sessions as aforesaid shall cause t r u e and exact p r in t ed copies of t h e table of such Fees as are specified in t he Schedule he reun to annexed to be placed posted u p and k e p t cons tan t ly in a conspicuous pa r t of t he room or place where such Office and Sessions are respectively held unde r pa in of forfeiting for every day upon which t h e same shal l no t be so placed posted u p or kep t t h e s u m of t en shil l ings and the Clerk of every Just ice ac t ing singly as hereinbefore ment ioned shall produce and shew if requi red to the person requ i r ing to see t he same a p r in ted copy of t he said Schedule upon his demand ing paymen t of any Fee and every such Clerk who shal l neglect or refuse to produce such copy on being requi red so to do as aforesaid shall forfeit and pay the sum of t en shill ings to be recovered in a s u m m a r y way before any one Jus t i ce of t he Peace Provided always Tha t t he penal t ies hereinbefore imposed shall not be recovered if complaint be not m a d e wi th in one calendar

3. A n d he i t fur ther enacted Tha t t h e several Clerks of t h e

several Police Offices and P e t t y Sessions shal l once in every th ree m o n t h s m a k e a r e t u r n in t h e form in t he Schedule he reun to annexed m a r k e d B to t h e Jus t i ces of such Police Offices and Cour ts of P e t t y Sessions of each district respectively of all Pees received by t h e m in the i r offices or places for business for services done or performed t h e r e i n such r e t u r n to be signed and sworn to by t h e m and t r ans ­ m i t t e d as the voucher of the i r several accounts and t h e said Clerks shal l for thwith t r a n s m i t and pay to t he Colonial Treasurer for t h e t ime-be ing the full a m o u n t of all such fees to be appropr ia ted and appl ied to t h e publ ic uses of the said Colony and in suppor t of t h e

Governmen t thereof.
