MR T.A. GAME:   If the Court pleases, I appear with MR S.J. GAGELER for the respondent.  (instructed by the Legal Aid Commission of New South Wales)

MR BASTEN:   Your Honours, the summaries of argument in this matter were delayed pending the hearing by this Court of the appeal in The Minister v Ibrahim.  Although the matter is now ready to proceed, it is our joint submission that this application should await the outcome of that decision.  We therefore seek an adjournment of the application on that ground.

GLEESON CJ:   Do you support that?

MR GAME:   Yes, your Honour.

GLEESON CJ:   Then, by consent this matter will be stood out of the list to await the delivery of reasons for judgment in the case of Ibrahim.  We will reserve costs of today.  The matter can be restored to the list on the application of the parties after judgment in Ibrahim has been given.  That is, if when that occurs the parties desire to proceed with the application.
