ON PRIVATE LANDS ACTS AMENDMENT [ASSENTED TO 5TH OCTOBER, 1950.] ACT OF 1950. B .l£ it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "The Mining on Short title· Private Land Acts Amendment ~ ct. of 1950,". and shall : ~ struction. be read as one with *" The M ~ mng on Prwate Land Acts, 1909 to 1929," herein referred to as the Principal Act. The Principal Act and this Act may collectively be <::Ollective cited as "The Mining on Private Land Acts, 1909 to tItle. 1950." 2. Section four of the Principal Act is amended- ~ ~ ~ ~ eIlts (i.) By adding to the definition of the term" Mining Acts" the words" t" The Coal lYIining Acts, 1925 to 1950," and any Act amending or substituted for this Act or t" The Coal Mining Acts, 1925 to 1950 " " ; (ii.) By inserting after the definition of the term " Mining Acts" the following definition, namely:- " "Mining tenement "-Any mining tenement as Mining defined by t" The Mining Acts, 1898 to 1948" : tenement. In applying the provisions of this Act to the grant of or an application for a coal-mining lease in respect of any private land, the term means the land held under the coal-mining lease or the application therefor, as the case may be ; ". 3. In paragraph (i.) of the proviso to section Amendment twenty-one of the Principal Act the words "or of s. 21. coal-mining lease" are inserted after the words "or mineral lease" where such words twice occur therein. 4. Section 21A of the Principal Act is amended- Amendments ofB.21A. (i.) By repealing, in the definition of the term "Private land" appearing in subsection two of that section, the words "The term, however, does not include- (a) A reserve; or * 9 E. 7 No. 15 and amending Acts. t 16 G. 5 No. 30 and amending Acts. t 62 V. No. 20, (b) So far as relates to coal-land (not being subject to *" The Agricultural Lands Special Purchase Act of 1901 ") which was alienated in fee-simple from the Crown on or before the first day of March, one thousand nine hundred and ten.", and inserting, in lieu of such repealed words, the words " The term, however, does not include a reserve." ; (ii.) By repealing the words" proviso next" where those words appear in the first paragraph of subsection three of that section and inserting, in lieu of such repealed words, the words "second proviso"; by inserting in the second and last proviso to the said subsection three after the words" Provided that" the words ", subject to the provisions of subsection one of section 33D oft" The Coal Mining Acts, 1925 to 1950,""; and by adding to the second and last proviso to the said subsection three the words" except where such coal is reserved or included in a reservation to the Crown in the instrument whereby the land was alienated in fee-simple from the Crown when in such case the coal is, and it is hereby declared always was, the property of the Crown." 1~ G N BO o . .2 V 0 I . .
