VIL No. 10. and Companies for the purpose of Providing THE MINING Machinery and Plant for Mining and the MAADCVHAINNCEERBY Treatment of Metalliferous Ores. ACT OF 1906. [ASSENTED TO 5TH NOVEMBER, 1906.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows ;- 1. This Act may be cited as "The Mining Machinery Short title• .Adva,nces .Act of 1906."

In this Act, unless inconsistent with the context- " Minister" means the Secretary for Mines or other Minister of the Orown charged for the time being with the administration of this Act; "Oompany" means any company incorporated or registered in Queensland under some public or private Act relating to the incorporation or registration of companies; " Geologist" includes the Government Geologist and any public officer or expert directed by the Minister to make inquiries or report with respect to any matter under this Act; "Prescribed" means prescribed by this Act or regu- lations. All moneys advanced or expended pursuant to this wexhpiecnhditure Act shall be provided out of moneys from time to time to be made. appropriated by Parliament for the purposes of this Act. Application. 4. Any person or company (herein called "the borrower") may apply to the Minister for an advance by way of loan for- (i.) Procuring and erecting machinery for carrying on mining operations; (ii.) Procuring and erecting, or removing and re- erecting, plant for treating metals, minerals, or metalliferous ores. Information 5. Every application for an advance shall be in s to up b p e lied. prescribed form, and the applicant shall supply the Minister with- (i.) A .description of the mine on or in connection with which the machinery or plant is to be erected; or, if not in connection with any mine, the proposed site and objects of such plant; (ii.) A description and valuation of any machinery or plant already erected on or in connection with such mine: (iii.) A statement of the encumbrances, if any, affect- ing such mine, machinery, or plant; ~ iv. ) A description of the machinery or plant which the applicant proposes to erect; (v.) A statement showing the duration of the pro- posed advance, and the time when and the instalments in which the advance is required; (vi.) Any further information which the Minister may require.
1906. MINING. Mining Machinery Adrances Act. 6. Every such application shall be referred to the Report of Geologist for report, and such report shall state- Geologist. (i.) Whether in the opinion of the Geologist there is reasonable probability that the mining opera- tions in connection with which the proposed machinery or plant is to be erected is likely to be of a remunerative character; (ii.) Whether the proposed machinery or plant is of a character and description properly adapted to the proposed operations and works; (in.) Such other information as the Minister may require. 7. (1.) The Minister, with the approval of the Governor Advance. in Oouncil, may grant such application, with or without modification, and may, on behalf of the Government, enter into an agreement with the borrower, undertaking to $1dvance to him by way of loan, bearing interest at a rate not exceeding five pounds per centum per annum, such sum as has been approved. (2.) Such advance shall be payable in instalments of such amount and at such times as shall be specified in the agreement. (3.) No instalment shall be paid until it is proved to the satisfaction of the Minister that- (i.) For every pound to be advanced the borrower has, out of his own capital, previously, but since the date of the agreement, contributed towards the purchase and erection, or removal and re- erection, of such machinery or plant a like sum of one pound; and that (n.) Th0 borrower has properly expended all previous instalments advanced under the agreement, and has paid all interest, if any, due on the amount already advanced. (4.) The agreement shall contain all such covenants, conditions, restrictions, and provisions consistent with this Act as the Minister may require. 8. (1.) All moneys advanced to or payable by a Remedies borrower under this " , - ~ ct shall be a debt due and payable ~ o~e~mnent. to His Majesty, and payment thereof may be enforced accordingly. . (2.) For securing the repayment of all moneys advanced to or payable by the borrower under this Act, the borrower shall execute all such mortgages, charges, liens, or other instruments over the mine or machinery

No. 10, 1906. or plant or other property of the borrower as the Minister may require, and such instruments shall contain all such covenants, stipulations, and remedies in favour of the Crown upon any default or non-compliance by the borrower with any of the provisions of this Act or the regulations, or with any of the terms of any agreement or instrument, as the Minister may consider proper. But the moneys advanced to or payable by a borrower under this Act shall not be recoverable against the borrower personally, but only against the mortgaged property. Annual report. 9. In the month of August in every year the Minister shall prepare a report of all moneys advanced or expended for any of the purposes of this Act during the preceding financial year, with detailed statements of his accounts with any companies or persons, and lay the same before both Houses of Parliament as soon as practicable. 1tegulations. 10. The Governor in Council may from time to time make regulations for carrying this Act into effect.
