2 Mining (Fossicking) Amendment (No. 1) No. 360, 1993 ˙ Short title 1. This regulation may be cited as the Mining (Fossicking) Amendment Regulation (No. 1) 1993 . ˙ Amended regulation 2. The Mining (Fossicking) Regulation 1989 is amended as set out in this regulation. ˙ Replacement of ss.3–7 3. Sections 3 to 7— omit, insert— ˙ ‘Definitions ‘3. In this regulation— “plan” means a survey plan held in the office of the department. ˙ ‘Forms ‘4.(1) The chief executive may approve forms to be used under the Act. ‘(2) A person may ask the chief executive to give to the person a copy of a document setting out an approved form. ‘(3) The chief executive must promptly comply with a request under subsection (2). ˙ ‘Fees ‘5. The fees payable under the Act are the fees set out in Schedule 1.
3 Mining (Fossicking) Amendment (No. 1) No. 360, 1993 ˙ ‘Designated areas ‘6.(1) The land included in Schedule 2 is a designated area. ‘(2) Each designated area has the name assigned to it in the Schedule. ˙ ‘Fossicking areas ‘7.(1) The land included in Schedule 3 is a fossicking area. ‘(2) Each fossicking area has the name assigned to it in the Schedule. ˙ ‘Camping prohibited ‘8. Land specified in Schedule 4 is land on which camping is prohibited. ˙ ‘Penalty payable on service of notice ‘9. The amount payable as a penalty with respect to a notice under section 40 of the Act is 1 penalty unit. ’. ˙ Omission of Schedules 1 and 2 4. Schedules 1 and 2— omit . ˙ Renumbering of Schedule 3 5. Schedule 3— renumber as Schedule 1. ˙ Insertion of Schedules 2–4 6. After Schedule 1 (as renumbered)— insert—
