Mining (Exempt Land) Amendment Regulations 2024

under the Mining Act 1971

Part 1Preliminary1Short title

These regulations may be cited as the Mining (Exempt Land) Amendment Regulations 2024.

2Commencement

These regulations come into operation on the day on which the Hydrogen and Renewable Energy Act 2023 comes into operation.

Part 2Amendment of Mining Regulations 2020
3Amendment of regulation 5—Exempt land – prescribed distance
  1. (1)

    Regulation 5—before subregulation (1) insert:

    1. (a1)

      For the purposes of section 9(1)(ca) of the Act, the prescribed distance is 25 m.

  2. (2)

    Regulation 5(1)—delete "This regulation" and substitute:

    Subregulation (2)

  3. (3)

    Regulation 5(2)—delete "regulation" and substitute:

    subregulation
