Mining (Ellendale Diamond Royalties)

Amendment Regulations 2008

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Mining (Ellendale Diamond Royalties)
Amendment Regulations 2008.

2.             Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on 1 January 2009.

3.             Regulations amended

These regulations amend the Mining (Ellendale Diamond
Royalties) Regulations 2002.

4.             Regulation 3 amended

In regulation 3(1) delete the definitions of above zero profit and
offset amount.

5.             Regulation 6 amended

Delete regulation 6(2) and (3) and insert:

(2)	The rate of royalty payable each year for diamond obtained from the Ellendale mining lease is 5% of the f.o.b. revenue for that year.
(3)	Subregulation (2) applies to diamond obtained from the Ellendale mining lease on or after 1 January 2009.

6.             Regulation 7 deleted

Delete regulation 7.

7.             Regulation 9 amended

Delete regulation 9(2).
