Mining Amendment Regulations (No. 4) 2017

Made by the Governor in Executive Council.

1.       Citation

(1) In regulation 2 delete the definition of Director, Environment
Division.

These regulations are the Mining Amendment Regulations
(No. 4) 2017.

2.     Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on 22 January 2018.

3.      Regulations amended

These regulations amend the Mining Regulations 1981.

(2) In regulation 2 insert in alphabetical order:

Director Operations, Resource and Environmental Compliance Division means the person for the time being holding or acting in the office of Director

Operations, Resource and Environmental Compliance
Division in the Department;

Executive Director, Resource and Environmental Compliance Division means the person for the time being holding or acting in the office of Executive

Director, Resource and Environmental Compliance
Division in the Department;

5.            Regulation 4B amended

In regulation 4B delete "Mineral Titles" and insert:

Resource Tenure

6.            Regulation 5 amended

Delete regulation 5(3) and insert:

(3) For the purposes of section 30(8) the prescribed offices
or positions are -

(a)	Executive Director Resource Tenure Division in the Department;
(b)	General Manager Resource Tenure in the Resource Tenure Division of the Department.

7.           Regulation 32A amended

Delete regulation 32A(3) and insert:

(3)  For the purposes of section 82A(2)(b) the prescribed
officials are -

(a)	Director Operations, Resource and Environmental Compliance Division;
(b)	Executive Director, Resource and Environmental Compliance Division.

8. Regulation 33A amended
In regulation 33A(1) delete paragraphs (a) and (b) and insert:

(a) Director Operations, Resource and
Environmental Compliance Division;

(b)	Executive Director, Resource and Environmental Compliance Division;
(c)

General Manager Minerals, North, Resource Department;

(d)

9. Regulation 898 amended
In regulation 89B delete "Mineral Titles" and insert:

Resource Tenure

10.          Regulation 113A amended

In regulation 113A:

(a)

delete paragraphs (b) and (c) and insert:

(b)	General Manager Resource Tenure; and
(c)	Manager Mineral Tenure; and

(b)

delete "of the Mineral Titles" and insert:

in the Resource Tenure

11.          Regulation 113B amended

In regulation 1 13B delete paragraphs (a) and (b) and insert:

(a)	Executive Director Resource Tenure Division in the Department;
(b)	General Manager Resource Tenure in the Resource Tenure Division of the Department.

12.          Regulation 116 amended

In regulation 116 in the definition of Director delete "of the
Mineral Titles Division of" and insert:

Resource Tenure Division in

13.          Regulation 120J amended

Delete regulation 120J(3) and insert:

(3) When reviewing a direction, the Executive Director,
Resource and Environmental Compliance Division
may—

(a)	take into account any active measures that have been taken by the mining tenement holder which result in substantial compliance with the direction; and
(b)	extend the time period for compliance with the direction, if of the opinion that measures already taken by the mining tenement holder will be completed within the extended time period.

14.          Schedule 1 amended

In Schedule 1 Form 1A delete "Registrar/Customer Service Coordinator,

Mineral Titles Division" and insert:

Registrar

15.          Various references to "Director, Environment" replaced

In the provisions listed in the Table delete "Director,
Environment" (each occurrence) and insert:

Executive Director, Resource and Environmental Compliance
