MINING AMENDMENT REGULATIONS (No. 3) 1998

Made by the Governor in Executive Council.

Citation

1.These regulations may be cited as the Mining Amendment Regulations (No. 3) 1998.

Regulation 86AA amended

2.Regulation 86AA of the Mining Regulations 1981* is amended by inserting after

subregulation (5) the following subregulations —

If the Minister is satisfied in a particular case that there are circumstances justifying gold royalty relief, the Minister may determine that in that case the rate of royalty payable for gold metal produced while the determination is expressed to apply is to be on the basis of a portion only, as specified in the determination, of the realized value of the gold metal produced, and subregulations (3) to (5) have effect as modified by the determination.

(5b) In subregulation (5a)

"circumstances justifying gold royalty relier means circumstances that meet criteria for the giving of gold royalty relief that the Minister has published in the Gazette.
