Mining Amendment Regulations 2022

SL 2022/118

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Mining Amendment Regulations 2022.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on the day on which the

Legal Profession Uniform Law Application Act 2022

section 6 comes into operation.

3.             Regulations amended

These regulations amend the Mining Regulations 1981.

4.             Regulation 2 amended

In regulation 2 delete the definition of lawyer.

5.             Regulation 128 amended

In regulation 128(1) delete “Legal Profession Act 2008” and

insert:

Legal Profession Uniform Law Application Act 2022

section 133

6.             Schedule 4 amended

(1) Delete Schedule 4 clause 1 and insert:

1.              Terms used

In this Schedule —

counsel (C) means a legal practitioner, other than a senior
counsel, acting as a barrister;
junior legal practitioner (JLP) means a legal practitioner
who has been admitted to the Australian legal profession for
less than 5 years in any jurisdiction in Australia;
PL means a paralegal;
senior counsel (SC) means a legal practitioner who has been
appointed a Senior Counsel or Queen’s Counsel in an
Australian jurisdiction and whose appointment is afforded
recognition by the Chief Justice of the Supreme Court of
Western Australia;
senior legal practitioner (SLP) means a legal practitioner
who has been admitted to the Australian legal profession for
5 years or more in any jurisdiction in Australia.

(2) In Schedule 4 clause 3:
(a) before “Legal Profession Act 2008” insert:

Legal Profession Uniform Law (WA) Part 4.3, the repealed

(b) in the Table delete “JL” (each occurrence) and insert:

JLP

(c) in the Table delete “SL” (each occurrence) and insert:

SLP

7.             Various references to “lawyer” amended

In the provisions listed in the Table:

(a) delete “lawyer” (each occurrence) and insert:

legal practitioner

(b) delete “lawyer” and insert:

legal practitioner

(c) delete “lawyers” and insert:

legal practitioners

(d) delete “Lawyer” (each occurrence) and insert:
