Mining Amendment (Fees) Regulation

2011

Mining Act 1992

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Mining Act 1992.

Explanatory note
The object of this Regulation is:

(a)

to prescribe the fee payable for the registration of legal or equitable interests in mineral claims and opal prospecting licences, being $65, and

(b)

to require the registers of interest in mineral claims and opal prospecting licences to be kept at the Lightning Ridge office of the Department of Trade and Investment, Regional Infrastructure and Services.

This Regulation is made under the Mining Act 1992, including sections 218B (3), 218B (9),

235F (3), 235F (9) and 388 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Mining Amendment (Fees) Regulation 2011.

2      Commencement

This Regulation commences on the day on which Schedule 1.15 to the Personal Property Securities Legislation Amendment Act 2010 commences and is required to be published on the NSW legislation website.

[1]      Clause 46

Insert after clause 45:

46 Register of interests in mineral claims

For the purposes of section 218B (9) of the Act, the prescribed office of the Department at which the register of interests in mineral claims must be kept is Lightning Ridge.

[2]      Clause 53

Insert after clause 52:

53 Register of interests in opal prospecting licences

For the purposes of section 235F (9) of the Act, the prescribed office of the Department at which the register of interests in opal prospecting licences must be kept is Lightning Ridge.

[3]      Schedule 10 Fees

Insert after item 59 in the matter relating to Mineral claims in Columns 1 and 2, respectively:

59A Registration of legal or equitable interest (section 218B (3) of the 65

Act)

Insert after item 60 in the matter relating to Opal prospecting licences in
Columns 1 and 2, respectively:
60A  Registration of legal or equitable interest (section 235F (3) of the 65
